i was at a red traffic light, and blue flashing lights of a police car were behind me, not wanting to move in case i get flashed by a camera on the junction, and then getting 3 points, the police were very annoyed, and after it was orange on the lights i have moved, they opened there windows and started screaming y i haven not moved, so i said i did not want my 3 points because of them, in rage they said hey u r not wearing a seatbelt, and told me to turn in to a side road, where they checked my insurance and licence, then they slept me with a fine for not wearing my seatbelt, as they gave me my ticket, i demanded they put it in my car, and as they did, i took the ticked from my car and ripped it up in front of them, as to 2 protest that they only gave me ticket for not moving when it was red at the lights,

so they said hey u r under arrest, asking why, they said as the ticket is now ripped in two, its no more valid and the only way to deal with it is in custody, so they called for a van to arrest me in front of like 70 people

i was charged with not wearing a seatbelt,

im questioning how could they issue me a ticket for seat belt if they were on an emergency,

im askining if i ripped up my ticked which was still valid as i could still pay the £60 fine and it was my ticket, how could they harass me and arrest me,

i am asking as the ticket was already given to me so the action was done, so how by me tearing it up did that make the ticket invalid so i have to appear in court? was the action of ticket issued not make it a closed case? so why do i have to appear in court??

as i suffer from depression, and take medication for it, and i have bipolar disorder, i had a panic attack in the station which can be viewed on camera at the station in custody, wich even left me crying and speechless, can i sue for wrongful arrest? and having a panic attack because of it? and i am still tromertised from it....

please reply if u can help?

i received a notice of intended prosecution from the police on thursday for the following offences. 1)driving without due care and attention 20 failing to exchange details 3)Failing to report a RTA, following an alleged RTA on Saturday. i was completely shocked because i was not involved in a RTA although i do recall driving at the said location and date. i have to produce my driving license, MOT cert. and Insurance policy to th police within 7 days. i have these documents, but when do 7 days limit start from is it date of letter or date when i received them, doesn't help with long eater weekend inbetween!. what will happen when i take the documents to the police? will i be cautioned and have to go to court? do i tell the officer i don't know anything about the RTA? if so will they interview me? i also have a letter which i must send within 14 days, asking me to name the driver. should i fill this in and take with me when i go to the police sataion? i am very worried and stressed and want to sort out the mess without incurring any points or fine or court as i have two small children aged 5 and nine months, am very stressed, as i don't know anyhthing about being involved in an accident. how can i resolve this?. if i tell the police the truth that although i was driving at the time, but don't recall being involved in any RTA will they beleive me and what will happen next? i have a clean license for 10yrs and have never been involved in anythiong like this. my insurance Co haven't got in touch yet will they automatically and what are the implications?. how can i go about resloving the issue and what is the likely outcome. i would be grateful for a prompt response, bearing in mind the 7 days deadline. thank you

I was stopped by police and given the above penalty due to driving at a speed of 52mph on 30mph road. On one side of the the round about the speed limit was 40 whilst on the other side of the same round about the speed limit was 30 which I was not aware of. The reason I was speeding is , my wife is pregnant on 30 weeks. She needed to go to toilet and was very anxious that she was having a pain, which may cause harm the the baby.Hence,she was persuading me to drive fast to get to the nearest toilet. On the way the Police officer stopped me, although I explained to him the situation and the reason for driving fast, he did not consider my wife's circumstances at all.

Therefore, I would like to dispute the Police officers' decision.

Please could you advice me the likelihood of me winning the virdict of judge on my favour.

I was stopped by Patrol Car,when looking for my documents I found that my insurance is not up to date,i thought my daughter who works for the company had renewed it after supplying me with the quote.I have six points on my licence and my job is a lorry driver.I fear I will lose my job,if i get more points.I have to produce by tomorrow

I was caught on a camera mounted on a roadside tripod in fromt of a white van. There where none of the bright markings that are on police vehicles it was just a plain white van with its rear door open (i have photo's of it). Also I drive down this road every day and there are no fixed road signs displaying the speed camera warning sign. Is this legal for both no signs and an un-marked van?

A friend who was also caught said that a sign had been attached to a lamp post during the day then subsequently removed after the van had finished for the day, seems like a pure money making scam to me.

I can only offer mitigation as I was unaware I had made contact wwith the other vehical I was parked next to. I want to avoid a ban. I work as a taxi driver and have had a clean licence over 20 years. I have never had a complaint about my driving to the cab co.

I was driving my own vehical at time of accident I pulled out of the parking space and scraped the car next to me without realising as my car has large tyres that scrape on the wing during tight turns anyway. The first I was aware was my insurance co. contacting me I confirmed there was a scrape on my car and they settled the claim. The police then decided to procecute me. What can I do to ensure I keep my Licence as loss of would cause loss of my cab and unemployment.

I was driving my girlfriends car, someone reversed into me in a petrol garage, we swapped deatils, she reported me to the police for not stpping at an accident, the police have asked for my giorlfriends insurance details at the the time, it turns out that her insurer at the time had cancelled her policy but had sent it to the wrong address. thay have confirmed that they did this. so at the time she had no insurance, I however amn fully comp. Once she realised that she had no cover she immediately got cover that night. who will get penalised? her or me as I was driving? and what will the penalties likely to be like? it was an honest mistake. Are we able to blame the insurers?

i got pulled over by the police the other day for not having any insurance but i didnt relise that i didnt have insurance on the car. but i did admit to having no insurance on the car in the end but said i didnt no that i wasnt insured on the car. what point and fine do you think i will get for this?? and how long does point stay on your license for?? as ive already got 6 point on my licence but they were in 2007 and 2008??

Hi,

i have 10 points on my licence and have just been caught for a PC32. Im a self-employed builder and losing my licence is going to be a major problem as driving to and from work is key to me earning money. If i lose my licence i will lose my house (rented), my van (business loan) and most of my clients (they will be forced to use someone else). What is the chance of me keeping my licence?

Points so far:

3 for being on phone

4 sp30 (working away and missed handing in my licence by 1 day)

3 sp30

3 pc30 (pending).

I have no kids or morgage but my job impossible without licence.

Please help.

The camera was in a mobile speed safety van.

I accelerated away from a roundabout on to dual carriargeway and was detected as driving at 40mph.

I may have been doing over 30 but I don't beleive it was 40mph. I had only just come away from the roundabout and the camera was around a right hand bend obscured by a line of trees. A central reservation was on my immdeiate right and the trees would have prevented the camera from getting a good picture. Is there a minimum distance which the driver must travel at speed say xxx yards in order for the conviction to stick? Can I request a copy of the evidence?

Hi I have been issued with a fixed penalty notice for using a mobile phone whilst driving. However I had two phones in my car and one of which i was using through a bluetooth headset at the time, however the other phone had fallen off its cradle and i had picked it up in one hand and thought there was a text message which i didn't check but went to take out my headset from my ear with same hand holding the other phone (which the police thought that i was using). I had immediately stopped and pulled up to the side about to check my phone when i had a police officer come to the side of my car and started shouting and barking for me to pull away from where i was parked and park forward. I was shocked as I didn't know what was going on. I parked in a different spot and he shouted again which was quite intimidating to tell me to move forward again so that they can park behind me. He then shouted at me to come out the car and bring my mobile phone and he didnt bother to check or tell me which one so i took the one i wasn't using. At this point i was shaken up and a bit shocked as to why they were calling me and in the car they said what was i doing? i replied i was checking my phone to see if had a text because i had thought they were asking me what i was doing when i had pulled up. They said they saw me with my phone to my ear and were going to issue me with a fixed penalty. They did not ask to see my phone or did not see my earpiece. I didn't sign the bit where i had said i was checking my phone as i wasn't sure what i had done. I believe they had assumed i was holding a phone and having a conversation with it but it was the other phone that i was using through the headset. I actually work for a mobile phone company and I am aware of legal implications of mobile phone use in cars but i think they made a mistake. I do have 6 points which are due to expire this year and i was just wondering do i accept the 3 points and fine for something i'm sure i didn't do or take this matter further.

I have had a letter dating 26th March for intended prosecution for 36 in a 30. The date of the offence is the 19th Feb. I have been told that they have to let you know within 14 days about the notice of prosecution.... is this correct? If so, where do I stand?

I scraped a car on the passenger side, it was parked quite close to the junction of a main road and as I was in a queue of traffic coming onto the main road and I could not stop as there was a pedestrian crossing with the usual restrictions I proceeded further along and pulled into a Tesco car park. By the time I had wrote out my details and telephone number and walked back to the vehicle it had moved so I was unable to leave my message. A chap who had seen the incident had approached me in the car park and I assume he is the one who reported the incident to the police, I did not realise I had to report it as no one was injured but they are looking at reckless driving and failure to stop/report traffic collision I have never been involved in a driving offence in 40 years of driving. Please advise as I am terribly worried I may lose my licence

I already have 6 points on my licence from 2 speeding offences incurred in last 16 months. (My first endorsements for 10 years) I had a crash last Friday on motorway when car suddenly veered left. Police have taken car away to exam for mechanical defects. I was warned by police at scene of accident I may be prosecuted for careless driving and have another 6 points on licence. If this is the case and I end up with 12 points can you help me?

I have received aletter that says the police may decide to take action against me following a car accident I had on the 23rd Feb.I have the choice of taking a Driver Alertness Course or facing the possibility of charges. I believe that they should have notified me within 14 days of the accident

but the letter was not received until 20th March. Would be very grateful of any advice.

I approached the junction , I stopped at the give way lines, my intention was to exit the junction and turn right to join the queue of moving traffic . Prior to commencing this maneuver I checked left where I saw an appropriate gap in the moving traffic, I then checked right, there were no oncoming vehicles, I slowly pulled forward to enter the gap in the traffic, whilst in the process of this maneuver my vehicle was struck by a vehicle from my right.

There were no oncoming vehicles as I conducted this maneuver, for the vehicle to have struck me it must have been travelling in excess speed, and in my opinion is the offending vehicle, as this vehicle was unable to stop and was not present on the road when I checked before pulling forward.

I have since driven the route of the offending vehicle, and although there is a natural bend in the road prior to the junction which I exited, which incidentally is the second junction after this bend, there is ample stopping distance, if travelling at 30mph, the speed limit .I believe my opinion of excessive speed is supported by the fact that this vehicle travelled on a considerable distance before striking another vehicle head on, travelling from my left hand side, surely this is dangerous driving as they have been travelling too fast or have not been paying attention to the road ahead hence not being able to stop in time.

The damage to my vehicle is on the left hand side, front, surely if I had pulled out into the path of the oncoming traffic the damage would be on my right. The vehicle struck me on my left as I was moving into the gap and I was already present on the road when I was struck by this vehicle travelling at excessive speed.

The police officer that cautioned me said that independent witnesses claimed I didn’t approach the junction slowly. It’s impossible to exceed the speed limit towards this junction, there was also a vehicle driving into the junction from Kings Ash road, as I was approaching it and parked vehicles on the right hand side of the road, so even more impossible to drive too fast. Regardless of this, I find it irrelevant to the incident that took place, as I stopped at the junction, and the incident took place out on the road after I had already left the junction.

In the below satellite images , the white vehicle stationary at junction is my start point. My intention as stated was to turn right and join the moving traffic (The traffic flow represented by this image is similar to the traffic flow on the day of the accident with the exception of the traffic coming from my right which was clear.

In the second satellite image, the red vehicle on the left hand side of the of road is where the second impact took place. This clearly outlines what distance the offending vehicle travelled after striking me out on the road on my left hand side front and striking the second vehicle head on.

I was travelling on the A4 through a 40mph limit and got caught doing 56mph by an officer with a speed gun. He went through the normal proceedures and he told me i had 28 days to produce my documents and pay the fine. However, taking my speeding ticket and all relevant documents to the police station the receptionist pointed out it says produce documents within 7 days and pay within 28 days. So, they took copies of my details anyway and sent them off. I have now received a letter form the fixed penalty support unit mentioning court. The letter is attached. Im a bit worried about this as i am a University student with not a lot of money and was wondering if you could give me some advise and how to set about solving this.

My daughter lives in Glasgow and has just accumulated 12 points on her license over a period of about 2 years and 6 months. She is a single mum of 2 young girls (6 & 5). The 6 year old attends school about 6 miles away and the younger one is at nursery about 3 miles from home. My daughter works about 60 hours per week for not much more then the minimum wage. She starts work at 6:00am and can be there until 22:00. The loss of her license would be catastrophic for her and the children as she would not be able to get the girls to school or herself to work. Public transport to the locations is not practical as it would take so long to get there or does not run at the times she needs it. She has no family locally to support her. Her mother and I live 55 miles away so cannot be there to do all the fetching and carrying if she was banned. Any ban would mean that she would need to give up her work and change the location of the school which would be extremely harmful for everyone and who are still coming to terms with the marriage break up. In your opinion, would she have a case under the Exceptional Hardship route ? Many thanks in advance for your help.

I was caught on camera on an unfamilair road,whilst driving to work early one morning last September.this was not a deliberate act I simply did not observe that there were any signs indicating a speed limit.However I have been to court and asked for mitigating circumstances to be taken into account but this was rejected, and I have been given a six months ban with a further 4 points on my liscence, and a cost of £278 to pay.

Can I appeal? this ban ? or is it simply too late to do anything now.

I could not afford a solicitor that is why I tried to do it myself,I will and am suffering extreme hardship without my car, I run a business where I need to see clients in their own homes,and run sessions in different venues,I carry a lot of equipment,and I am the sole breadwinner in my household,We stand to lose our home if I do not manage to keep up the mortgage payments which is currently in arrears,I will lose my job if I cannot get to work .

All this was put in my mitigating circumstances but it was rejected off hand,stating that my not having a car was merely an inconvienence.

I really do not know how to get around this.

Can you advise me please?

I believe that I may have been caught speeding, doing 50 in a 40 mile zone. This will mean 12 points to my license. The other 9 points were 36mph in a 30 mile zone. If my license is endorsed I will lose my job and not be able to take my kids to nursery. I do not live near to shops etc. I am in the country. Will I definately lose my license or might I have a good case for an "Exceptional Arguement" case? Thanks

I got pulled over last night by a police officer in a road traffic car.

 

I have an aftermarket exhaust fitted to the car, and it was blowing on the rear flange. The officer told me he thought it was blowing and I told him I had a new gasket on order for it.

 

I was issued with a £30 fixed penatly fine, carried no points with it luckily. I've looked this up on the internet and found two websites which state the policy to dealing with that offence is by vehicle defect note to rectify within 7 days, not a £30 fixed fine. My question, is the information I have found correct, and if so, where do I stand on challenging this?

I discovered that my insurance had lapsed and was involved in an accident.

I was charged and the court dealt with the offence which I admitted to because I reported that my insurance had lapsed.

The other parties insurers are now pursueing me under section 152 of the Road Traffic Act 1988 for £2500.

They have informed me that if I do not pay they will prosecute under the above act.

The other party had the oppertunity to appear in court for the hearing of the original offence for which I recieved a fine and 6 penalty points.

What i would like to know is what is section 152 of the RTAct and can they pursue me for the losses.

The accident was not my fault as the other party was on my side of the road at the time.

Already have 9 points on licence. Have received a'notice of intended prosecution' for speeding (35 in a 30 zone). Employed as a van diver so livelihood dependent on driving licence.Dependent child to support & significant personal debt (receiving debt counselling). Advice needed on presenting a hardship case to avoid a driving ban.

I have been cautioned for driving without due care and attention. The night in question I was waiting at a junction to turn right on the left of me was a stationery police car with his blue flashing lights on he flashed his headlights for me to come out but I didn't so he flashed again this time I pulled out he then accelerated behind me so I did the same to avoid an accident then drove on to a safe place to pull over there was no impact but the police are now saying I did not stop at the Junction and caused them to swerve damaging the shock absorbers on his car we were both breathilised and this was zero. I am a 60 year old pensioner and cant afford a fine what do I do if this is taken to court. I am completely innocent.

Your road traffic offence question: A diver on a lonely country road slammed on twice in front of me bringing us both to a stop in a dangerous s bend.When we came out of the bending knowing the road well and it was now a straight road I over took the car and drove home. never thinking anything more about it.We were going about 2 mph when I decided to overtake him.

Later the police came to me to say I had hit his car and not stopped and there was a witness 2 - meters away at a cross road that saw and heard me hit his car.I was driving a 13 yr old diesel rover car a bit ratterly but I never heard or felt the so called bump or I would have stopped. I suffer from chronic depression and was totally stressed out by this drivers behaviour but I did not hear or feel any thing at all. But the police and even my own solicitor are saying I must have but At that fearful point I did not. My solicitor as asked me to plead guilty but If I do I would be a lie because I really did not hear or feel a thing. The other drivers car had a scrap over the back wheel arch where I was supposed to have pulled round him and a broken wing mirror.

I am alleged to have failed to comply with a red traffic light. My wife had taken me to pick up my car from work and on the way back home I was stopped for going through a red traffic light. The light was definitely amber when I passed through it and in my opinion it was unsafe to stop due to the road being wet.

I have just received a Section 9 notice and summons with police statement attached. I had already decided to contest the charge due to the reason stated above but then noticed that there were a few points in the police statement which I am certain are incorrect. 1) I was travelling home (Westbound) on the A184 - the police statement states that I was travelling eastbound. 2) I was directly behind my wife's car all the way from my place of work to the point where I was stopped, my wife passed through the lights on green and I was just behind her passing through as they changed to amber - the police statement states that there were no other vehicles in front or behind, I even told the officer that I was following my wife but this is not noted. 3) The police statement stated that I was travelling East in lane 1 of 3 - I was actually travelling West where there are only 2 lanes leading onto the traffic signals, prior to reaching this point there are 3 lanes but lane 1 is a bus lane (I don't drive in bus lanes).

Any advice (preferably by email) on how to proceed with this would be gratefully received.

I received a requisition form MG4E from the police today 26.03.10. Given the delay, is there a statutory time limit for the police to serve this? It has been 16 weeks since the alleged offence.

In addition, the car that I was driving was owned by my mothers ex partner who had insured the car continually for approx 18 months and I genuinely had no idea that he had stopped doing this 3 months before I was stopped.So do not feel Ishould be responsible.

I would be grateful for your initial advice

i was pulled over for holding my iphone whilst driving as i was listening to music on it. when the officer came over he asked why i was using the phone and i told him i was playing music.

 

he made a note of this and gave me a FPN for fine and 3 points

 

i also dont get phone bills as i am with o2 and they do electronic billing over the internet.

 

what can i do to challenge this,. what evidence will i require and how likely am i to succeed?

Can a Gatso speed camera image be used in anything other than a speeding offence?

 

If you have time, below is a more detailed account.

 

 

I work nights and therefore I drive home early in the morning

On the way home there is a Gatso speed camera which I usually avoid by driving on the right (incorrect) side of the road.

 

The speed limit is 30mph and it has the equivalent of another lane in-between the two opposing lanes.

It runs through an industrial area on a straight road with good visibility and a clear line of sight for around half a mile. If another car etc was present it would easily be known to me and the manoeuvre can be aborted. When all this happened it was dark and therefore headlights would have been easily noticed on other vehicles if there were any!

 

There are no markers on the right (incorrect) side of the road which I was driving on at the time the camera set off.

 

I have done this before and many times, as I say its my regular route home. Every time I have been flashed and yet nothing has come through. Ive certainly done it 20 times+, it may have just had film in it this time.

 

Here is a photo I got from google earth that will hopefully clear up any confusion. As you can see the camera is bottom left.

One point that could have been a factor would be the entrance/exit on the right if it was not for the fact that it is gated and closed between the hours of 7pm and 7am.

 

I did this at roughly 0200 and 0500 on separate, yet sequential, nights.

 

The speeds it states in the summons within the witness statements (the officers who have been processing this) are 48mph and 50mph. It could be a minor point but it says recorded speed, to my untrained eye that sounds interesting.

 

There was no accident and no witnesses to all of this apart from myself.

 

I have not received anything for speeding on the original NIP and have only been summons for 2 counts of Driving without due care and attention since I did this on two different nights.

 

They offered me a voluntary interview that I respectfully declined.

 

As far as I know driving on the other side of the road is not an offence, nor is avoiding a speed camera.

 

Also since I wasn’t within the markers I am unsure whether they have any other ways of working out my speed other than what it says on the photo.

 

Nor do I believe that the speed is a relevant factor in this case and even if it is they can’t prove it.

 

They have still photographs from a gatso speed camera on both nights and no witnesses.

For all they know there was a something obstructing my route that forced me onto the other side.

I have just been stopped by the police for failing to obey a no entry sign, and given an endorsement. They copied my address onto the endorsement slip from my driving licence.

 

My correct address is on my driving licence, but they have copied it incorrectly, writing the wrong flat number on the form. All other parts of the form have been completed correctly - is this endorsement invalid because of the mistake with the address?

we counciled a insurance on a vehicle after it was stolen but an admin error meant we counciled the wrong vehicle and a member of staff had a accident, unkowing to us stillyards ltd we wasnt insured , now me being the company director im faceing a ban is trhis legal considering i wasnt driving and i didnt council the wrong insurance ive pleaded guilty but the courts dont seem the listen to the reasons

Hi Emma, I've used your services previously for my brother late last year. I received an NIP for excess speed (30). Me and my wife both share a vehicle, and I could not remember who took it on that day. We wrote a response indicating:

That the car was taken to a local farm on that day which we visit 2 or 3 times a week. That me and my wife take turns. That we both went to the farm separately to ask if they could remember who came in on that particular day. They could not remember.

We also checked our banks statements to see if either of us went to the local Safeway supermarket (as we normally do after visiting the farm) - this would help us identify who took the car (from the cash withdrawal or card payment). There are no entries for that day.

I then wrote to the police saying, I can't provide them the infomration and have taken reasonable diligence.

They wrote back, saying that I have failed to provide information. So I wrote back saying that I 've done all I can, and all I can do is ask for the photographic evidence, as that may help me further. They sent it, and the photo is not helpful at all as you can't see anything.

So that's where I am right now, and in their leeter they quote the usual clause in section 172 (2) a, but also clause (b) that mentions "any other person shall if required as stated above, give any information which it is in his power to give and may lead to the identification of the driver".

I am intending to write back and say that I am still unable to identify the driver. Your advice would be helpful. Thanks"

My son passed his test 9th April 2008, he has 3 points on his licence and has now been reported for for the above. His court case is due very soon.If the case is heard after his two years driving and he gets 3 more points will he be liable for a re test.

Got flashed on red (turning right)?

hi

I was turning Right and i already crossed the white line as far as i remember my car was on the pedestrian crossing position signalling right. there were 2 cars on front of me waiting to turn right so I could not proceed because of them. and when light changed from green to amber and red the 2 cars in front of me moved away turned right. but I didnt move on as felt to wait for green light. few seconds later there were 2 cars behind me. and i saw camera flashes.

now I was wordering why the camera flashed? was it for me? or another car?

will i receive a penalty notice? if so how can I appeal? how the process work?

do I think I made any offence? i didnt go on red light. i was turning right on green crossed the white line waiting for red to come and turn right. but my car was still stationery. but when signal light changed and i saw a flash.

can you please advise me.

I was stopped driving a friends car today and was told I have no insurance to drive it. My car insurance policy covers me to drive someone elses car third party. So I believed that I was insured. The reason they said I had no insurance was because my car was scrapped. I was not aware of this as I had given my car to a mechanic to do MOT repairs and he had scrapped it without my knowledge or so it seems( I have been unable to contact him yet) I have explained this to the police at the time but they did not really seem interested.

Please help I have not had my licence long and I really dont want to lose it.

My wife has received from the Met police a request for information. she has been alledged that she drove without due care, and failed to report an accident. this all refers to her parking in a supermarket car park. She says that she remembers slightly touching a parked car when trying to park in a tight space, but looked out the windowe and did not see any damage.

What should we do and what the realistic outcomes here?

I was stopped 3 months ago using phone but my licence was away getting renewed so could not produce it and was told by police officer I would receive a summons he did not give me a ticket or any paperwork. I was driving with my mobile in my hand whilst talking into my handS free parrot, the office believed I was talking thru the phone and infact was thru my hands free parrot. he checked my car to see if I had a hands free parrot device and still issued me a ticket whilst driving at the wheel. I told him it was in my hand and put it on the passager sent whilst I was talking! which he saw me do, I told him the person I was talking to on the device was a witness to me talking thru the handsfree. And he just said present your case in court!

my car activated a camera 02/06/09.

i originally filled out the form with my details and sent them to the ticket office.

when i recieved my conditional offer through the post i noticed it wasn't a speeding offence, but failing to stop at a light. i had no recolection of travelling through a red light and investigated. to realise i was driving the car at the time it was caught on camera.

i noticed via tracker the car had travelled to a location were i play football usually. i normally play on a thursday, but due to the pitches being relaid our slot was moved to a tuesday at this time. i never played on the rearranged tuesdays because of a back and groin injury i sustained before the switch of days.

i did drive my car that day, but clearly my journey didn't take me past the camera. the camera was activated when it was being driven to football, while i was be driven home in another car.

i have questioned both my brothers but they can't recolect passing through a red light. i asked for photographic evidence but only shows the rear of the vechilce.

i drive a company car and at this time it would be usual for me to allow my brothers to drive it.

it has now come to light as a result of this case the company say only named drivers are insured regardless if the driver has a private policy.

I paid in advance for one years insurance which would run out in June 2010. When stopped, the police said I was not insured. On phoning the AA, they told me my insrance was cancelled at the end of Jan and that aletter was sent recorded delivery telling me this. They said it was at my request this happened although I have not cancelled my insurance. I never received the letter telling me this and I know this for a fact as I was away from home during that period so could not have signed anything. I want my insurance to be reinstated from the point it was stopped as in 2 weeks time I have to go to court and prove I had insurance when stopped by the police. Do I have a case to get my insurance reinstated and back dated?

I have recieved an NIP from Lincolnshire police for a speeding offence.

 

The Vehicle was LC09 HUH and was hire car from Hertz uk Teesside Airport.

 

The alleged incident was 26/01/2010

 

Hertz uk Recieved NIP on 12/02/2010

 

I recieved NIP on 20/02/2010

 

As the NIP did not arrive to registered keeper within 14 days (actually arrived 17 days) i have not replied to my NIP as i beleived it to be invalid.

 

I have now recieved a reminder on 19/03/2010 giving me 7 days to reply.

I was pulled on the motorway 'sposedly' doing 78mph but at 1st it was 80mph than 76mph and than ended up at 78mph. but when i asked what proof he had they wouldnt tell me just kept telling me to be quiet but before that they had cut me up and I shook my head which is all they kept saying in the car. is it worth me taking it to court or shall i just pay it and take the 3 points to get it over with?

I received an NIP for the offence, which occurred in central London, in early December, within 14 days of the date specified.

 

I requested photo evidence to help identify the driver.The evidence didn't help identify the driver but showed I had crossed the red light, but by <1 sec.

 

After 28 days I received a reminder letter saying I had 7 days to give evidence of the driver.

 

I sent off my details as the driver, expecting an offer of a fixed penalty.

 

I was surprised to get a summons through the post yesterday saying if I was convicted the prosecutions would apply ofr costs for £75.

 

I was offered and accepted a fixed penalty for going through a red light in the summer of 2007 so perhaps this explains the lack of fixed penalty offer?

 

I am not intending to contest the prosecution but would like to keep the punishment to a minimum.

 

I will offer contition but not sure whether to also say "I expected a fixed penalty offer, this is a waste of the courts time". If it has gone to court because of the repeat offence it could look as if I am not taking it seriously.

 

Could you give me any advice?

I was using my headset whilst driving and it fell off my ear and the phone fell onto the steering wheel so i held it placed it on seat.The police saw this and followed me home. When i was outside my house parking up i used my phone and the police came next to me and told me to not use my phone, i said im parking up.then he told me to get out of the car and issued me with a fine and 3 points.I pointed out to him i was on headset prior and am parking outside my house now.He said we saw u on the phone and would not show evidence.I said check my phone calls, i did not make or receive a call at the time he stated.Should i challenge this in court or not?

My query is very similar to that on your answers database with the heading "We don't know who was driving? Mar 23, 2010". I have received a NIP stating my vehicle was photographed by a LASTEC mobile speed camera doing 51 in a 40 on a dual carriage-way. There were two other people driving my car that day and I genuinely don't know who was driving at the time of the alleged offence. So, 12 days ago I called the relevant police department asking for a photograph so I can identify the driver. The adviser said the photo is of the rear of the car and you can't see who was driving. I said well I'd like to be the judge of that, please send me the photo. They said to send a written request for the photo which I did, immediately, via email. Today is 12 days after I sent the email and only 9 days until I have to provide a response to the NIP, so I called them again and a different adviser said "Sorry your letter of response it still on our pile, you should receive it this week", nice delay tactics I note. The guy also said my request was referred to the traffic officer who has refused to provide the photograph as it is inconclusive and does not show who the driver was. I find it absolutely ridiculous that they are asking me to identify the driver but cannot provide a photograph for me to do so. I raised this with the guy on the phone who sympathised with me but just kept saying "As owner of the vehicle, you are required by law to know who is driving the vehicle at all times". Is this true? Is this the only leg they have to stand on here? I said, "So if I don't know who was driving and you can't give me the photograph, do I just have to admit it was me and hope that you don't have evidence proving it wasn't, in which case I would be providing false details and committing perjury?" The guy sounded confused and said, "Errr, yeah". Fantastic, brilliant, what an amazingly efficient system we have here! Please can you help?

The time on the NIP is incorrect. There is a possibility that I did run the red light, however at the time on the NIP I can prove that I was elsewhere.

I returned the s.172 and said I was unable to identify the driver at the time on the NIP. I have now been contacted by the police and asked to view photographs and to bring my car for verification.

Have I got enough of a reason to argue the NIP, and if so how do I go about it?

I was driving & my mobile was in my pocket when it rang & I stupidly automatically answered it, The driver in front of me noticed & stared getting annoyed & gesturing, quite rightly, the call was ended, I was not officially stopped & don`t know who he was but he did look quite official & I was driving very close to a police station!! he slowed up let me pass him, I don`t know if this was to get my reg number to report me, as you can now understand I am worried, at the moment I have & have always had a clean driving licence, I just want to know if I should now expect to recieve something in the post, Thank you.

I had comprehensive cover on my van and the policy did not show that I could not drive another vehicle with the owners consent(which I had. However, after the event I found the restriction was shown on the back page of the brokers letter to me. Would I be able to appeal against the points, as I am unable to get new cover with an IN10.Many thanks,

We have one car and my wife is the registered owner.

She received a request for driver information but as she was off on that day and I was working from home and that we both have probably driven the car at some point on that day, we genuinely couldn't remember who was driving when the notice was received about a week later. Therefore, we asked in writing if they could send us the photographic evidence so that whoever was identified could plead guilty to the offence. However, the photo was taken from the rear and moreover,we couldn't even identify who was driving from the rear view mirror which is what we were hoping for. Therefore, we wrote back, explained the situation and asked if my wife as the registered keeper could be offered a speeding course instead of a fine and 3 points, which we both want to avoid although we both have clean licenses. This wasn't accepted either and they now want my wife to either admit in writing or go to court.

I read some of the stuff on your website which, by the way is very helpful, but I am frustrated about the fact that one of us is being forced to admit to the offence although we GENUINELY can not remember who was or might have been driving at that time on that day. What should we do and what are the chances of prosecution if we went to court? Thank you for your kind assistance and advice.

Have 4 notifications of impending speeding-minimum of 3 points each. So assume will be banned if cannot find a way to change this?

Have not responded yet but have oppurtunity to go for a day course but will this apply as I have others?

Two recent ones occurred on same night when got lost in Bristol and went around the block twice and got camera picked me up doing 37mph in 30 zone. I missed the signs unfortunately due to noise from friends in car.

i was wondering if you could give me some advise on the following. i was recently stopped and issued a Fixed Penalty Notice (non-endorsable)automated numberplate recognition fine for £60.

It is the first time I have been stopped for this offence. It was my fathers car and I had no idea he had put a little sticky black 'dot' in between the 11 to make it appear as a 'H'. that aside, I was given this fine. they also made me sign a piece of paper to acknowledge the receipt of a 'DVLA' document on how to display registrations. I thought it was a bit unfair that I get the document after I received the fine. Anyway, on the FPC notice the traffic officer forgot to put down my first name (even having handed him over my drivers Licence. ) So this section is blank . However the Penalty notice does show my surname and DOB. I was wondering as this is blank does the charge still stand as the form is incomplete? You reply (by phone if possible) would be very much appreciated.

My brother is a named driver on my insurance.He drove another vehicle which he was not insured.

Before he entered the vehicle i assured him that we had full comprehensive cover on the other vehicle which allowed us to drive other vehicles.

I feel I am responsible as I mislead him as he drove the other vehicle with full knowledge that he was insured to drive.

Can he plead special reasons?

i was doing a favour for a friend, by giving him a lift. He told me the policy was covered for any driver. As it was in a rush, I did not think to check the paperwork, and trusted my friend. I was then pulled over and given 6 points and a fine. I have had my license under a year and if I get 6 points then I will have to do my test again. I have got a court date in june. What will happen, what should i do? Do i need a solicitor and if so how much do they charge? Also I have incurance on my wifes car, and thought this would cover me, but have been told due to me not being the policy holder, I am not covered

got three year ban because 2nd offence in 10 years , 2 years is up 04.04.2010 and really causing me and my family problems not having a licence . new daughter arrived and have my own business which requires my licence so most if not all profit goes to paying driver to keep my work going . is there a chance of getting my licence back once the 2 years is up . regards james

partner driving car in 30mph zone caught on camera speeding in sept 09. letters received whilt i was away on work abroad requesting i notify police of driver which i could not respond to, eventually did respond providing partners details as the driver, though rejected as teh form was not signed..eventually summoned to appear before court on 16th march. did not attend pleaded guilty and given 6 points on my license and fine of £600. must be paid by 30th march. is there anything i can do to overturn this? shouldnt my partner get points rather than me? please advise asap

I bought a vehicle 2 months ago and I did not intend to use it until i get my full license, therefore i did not buy any insurance for that vehicle. A friend of mine had to use my car for some reason, so i told him that i had no insurance for my vehicle if he going to use that he have to responsible and so he agreed. He also show me his license to drive although its not a British one but it is still valid, he agreed and i permitted him to use my vehicle. I was under the impression that he is going to obtain the insurance. One day, he drove my vehicle and get caught for driving without insurance and valid license. I got charged for allowing him to drive and ended with 2 offense, will i be ended up points being imposed on my license? How much fine will be getting? I still on my provisional, i would've not allowing this to happened as it jeopardizes my opportunity to obtain a full license. Is there a chance the judge not to imposed any penalty points on me if I argue for a Special Reason?

I would like representation on a 2 year driving ban appeal,because

* I was not given the right to a solictor

* the clerk winked at reporter and prosecutor,

* the NIP i had recieved after the the court case of my first conviction, where i was given 7pts and fine, this was in my absence, then i recieved the nip, there other two got dealt with together, no nip was given to me,

* the sentence given to me is a mis carriage of jusistice, and currupt. and manifestively excessive.

On Tuesday 12th March at 4pm i was travelling to B hospital as my mum got rushed in by ambulance as an emargency, I followed on to the hosp an hour later. And I took the trun off on to in 40 mph road in stop stat traffic, I couldnt emergency stop so i went into the car in front of me, and so the car in front went into the next car and next car. so Four cars involved. I didnt manage to do a emergency stop in time. Of course i was shaken up and taken by ambulance to hosp myslef. At the incident my phone was checked which was fine, none of us got breathalised at all which i find amazing. Yesterday I got called into Police station to give a statement as i havent been able to do this due to my mum being critically ill in hosp and trying to manage two young children. Basically the other cars have said that i pushed them along the real damage was to my vechile and slight to others, nobody else was hurt except for myself. In the meantime P.C had said over the phone that i wasnt being presecuted and then last night she puled this one on me, plus also which my husband and i didnt realise our car needed to be MOT by Jan 25th 2010 and it hadnt. So this is where iam at the moment, so worried and upset as i have never had a driving conviction or points on my licence. the only ohter thing i was told that i couldnt do the driving course anymore as Essex dont do it anymore can you beleive this . At the incident i was treated terribly by the police all six of them, and i feel so very low and depressed about this in such an innicent situation it was a pure accident and nothing else, i have never done wreckless driving before but i was so worried my mum would of died in the ambulance. I didnt cause any injurys to anyone and at such a slow speed. I do feel this is so unfair. And of course im not happy by the way the police have treated me in this incident. I look forward to your reply

My brother had an accident with a pedestrian while driving my car and he was not insured. The pedestrian was trying in the middle of the road trying to cross but he was not at the pedestrian crossing. He was taken by police and he is told to wait to hear from the court.

He did not have permission to drive the car. The pedestrian lost a few teeth I believe and maybe some light facial injury.

What will be the charge of my brother? Who will be liable for the costs relating to the pedestrian? And what will happen to my insurance?

I have recently had my driving licence revoked following a court conviction of 3 points. I went to court due to a speed camera, this is copy of leter i sent below. We have to accept the car was ours but photo doesnt show either, at court the jp suggested did we think the car was cloned which may be the case, this is now going to trial, my husband nor i can recall driving the vehicle on the day. The jp told us we must now get legal advice, any help would be appreciated

I've progressed to the stage where I got the Mags to issue me with 'the video' free but it is now 5 days late from the 20 day ruling. I applied for a pre trial review after I got this video as Dr M Clark and T Farrow are going to look at it as they know this is crucial in this case. The CPS state that it is their prerogative whether the evidence is admissible????? I have asked for further evidence re can the operator give evidence in writing that he is able to assess the speed within 10% accuracy at 161 metres within 4 seconds due to the car appearing in view from a bend within4 seconds.

The terminology they state is Trial Hearing 9th April so am I correct in interpreting this as a pre trial review and not the TRIAL???

I was caught speeding at 50mph in a 30mph area

There were no excuses for doing so and it was definitely me

Points:

I had a TT99 in 2004 following an accumulation of points for speeding, which I served

I got 3 points in March 2006 – which have now lapsed

I got a further 3 points in April 2008, so they have 1 year remaining

I cannot do without my car for work use as I run a small business with a total of 9 staff and I need to get to see customers over the UK

 

 

Questions:

 

I would rather not receive any further points and go on a course to help understanding on my part, is this possible or likely?

If I am to receive points what is the maximum they could give me, I note it could be anywhere from 3 – 6, is that right?

Is there anyway they could ban me and is this likely?

Should I plead guilty through the post or actually attend the Summons?

I was recently clocked doing 98mph on the M4 (West) and have recieved the form for driver identity. I am guilty of this offence, but am worried that I may recieve a ban, which would in turn mean losing my job, house, etc. Is a ban a certainty in this case?

hi,im a taxi driver who was stopped at 3.55am on a very wild and wet morning on my way home from work, it was just normal police in a normal van whom accused me of running a red light on which i swear it was amber. the police were at a right angle to me and could not see from where they were positioned the white line i broke on amber and maybe never even saw the 2 white lines on my side were staggerred in my favour.am i in a no win situation due to there being 2 of them and one of me ?

I recently had an accident when my car wheel hit the curb and caused me to lose control temporarily after I misjudged a bend having moved well over to the left in order to avoid a van which pulled out and came over to my side of the road, this resulted in me hitting a council bus sign.I regained control of my vehicle but when a police officer came to the house and asked me to present my documents which i did the same day he also intimated that someone had accused me of speeding which I cateogorically deny.I am worried now that this persons word will result in me being prosecuted as i have received a letter saying thankyou for submitting your details we will be in touch pending further investigations.

Can someones word against yours be enough to be prosecuted? I have an idea that the person who has made these allegations is the man who arrived ten minutes after the accident and started to make comments like I bet you were speeding because we always get cars speeding down this road.I am really worried as I have no offences in five years and I have damaged my immaculate car and would never put me or my car at risk.

First, thank you for such a helpful website. My friend Yossi who has asked me to ask this question was "caugh" driving without insurance at the drop off area at Heathrow airport. He has fully comp insurance and was driving his father's car thinking he had third party on it which he ultimately did not. I am wondering wehther he can enter a plea in mitigation for special reasons that he is only driver in family and has 5 kids and 6th on the way and these 6 points on his licence ( that he has now received) - in addition to 3 points already there - will mean that he is very close to losing licence which will make family life almost impossible. Thank you

my dog got off its lead on tuesday night 16th march. the police witnessed the whole thing. a girl knocked her down, she stopped looked over her shoulder and then drove off. 48 hours later she still hasnt reported it. is this breaking the law on her behalf and can i prosicute her as i had £180 vet bill to pay.

i was stopped today for 'using my phone while driving'

 

what actually happened was that my phone rang, and whilst reaching over for my handsfree it fell on the floor. upon reaching a red light, i bent down to pick the phone and when i sat back up, i had the phone in my hand and there was a police officer in the car beside me who saw me holding the phone in my hand.

 

he stopped me and charged me and gave me 3 points as he said i was using the phone from before the lights.

 

i have evidence on my phone that i have 3 missed calls at that time as i did not answer the phone. and i also mentioned to him and showed evidence that i had just been informed of a death of a friend earlier.

Hi, i have 10 points on my licence, all for speeding (i got 4 as they did not receive my fine paid and i had to go to court, i did pay it though....but thats the reason i ended up gettin 4 instead of 3) i now have another 3 poinds pending for being on my mobile , i wasnt on my mobile i just had it in my hand. i have until the 24th of march to pay this, if i pay it i will be faced with a ban...can you give me advice on what i should do. do i wait till they ask me to go to court, or do i pay the fine. if i call and pay the fine but dont send my licence in will the dvla automatically send me a letter to send back my lience? whats the best thing to do. i really need my car to go to work and college even thought they are only half an hour away its a real inconvenience....really need help. thanks.

I am 22 years of age with a full uk driving licence , my other half has just started driving and is still a learner driver, I was driving her car to pick her up. got pulled and got told was not insured compleatly unaware i was causing a crime. 6 points will make me lose my licence. I have never broke the law, and pay full insurance on my car and pay the insurance on the other car for my other half. It looks as if alot of people over look this as it is not clearly known! will the courts look at the case in a different way if i am liable to lose my job and possible claim off dull/job seekers as surely they would not want to be housing and paying for me to live? also to take into consideration I am legal to sit next to my partner and tell her how to drive but not legal to get her out of a situation she may not feel comfortable in??? surely that is a massive loop hole in the law. please get back to me.

How serious are the alleged offences and is it likely to lead to imprisonment? Also, MUST I attend court if I pay a traffic solicitor to attend on my behalf i.e. judgement to be made in absential? I have given a guilty plea to these allegations and have no intentions of changing my plea. Will be grateful for your advice.

I was involved in an accident whilst over the limit. I have been charged with both drink driving and driving without due care.

I didn't know of the PCN until bailiffs clamped my vehicle outside my new address.

i was knocked of my motorbike on a roundabout. there is 6 exits on the roundabout and i was exiting the 3rd.i stayed on the outside lane as i was taught by a driving instructor. all learner drivers are shown the exact same way.i enterd roundabout behind a van and he went straight to centre lane, he the realised he missed the 2nd exit and cut back straight into me, i sufferd broken bone in foot ,finger and ribs.now iam told i could be prosicuted for being in wrong lane.i have spoken to driving instructors and examiners and they all say i done no wrong.any advice you could give would be of help

I have received a request for information and NIP relating to a speeding offence allegedly recorded by a mobile radar camera.

I have received copies of the images. These images show a close up picture of the vehicle and a recorded speed of 38mph.

In no way is it possible to ascertain the location of the vehicle at the time the photographs were taken. I believe the camera was sited near a change from 30mph to 40mph and that, in fact, I was past the change and in the 40mph zone.

What evidence is required to show the location of the vehicle at the time the image was taken?

hi, i had missed my turn off for the M6 and was entering the m6 toll, i realised i had forgot my wallet and had no cash so i decided to cross the hatched markings on the slip road to get back onto the M6, its the 1st time ive ever done anything that stupid, it was a silly slpit second decision but i paniced as i didint have any way to pay the toll fee, im a HGV driver and very concerned about the possible penalty i will recieve. i wasnt pulled over but there are camera's on that stretch of motorway. what penalty would i most likely recieve and is it likely the cameras would have picked it up?

i was driving a lorry at the time.

any advice would be appreictated

Via a Gatsometer photographed doing 40 in a 30mph. I admit speeding but there are mitigating circumstances ie 5.41am, no other traffic;area unknown to me;looked run down;semi-dark and being harrassed by men in a white van using disgusting language, moonies etc so I was attempting to get away from them so feel I should argue my case - am I right to do so?

The NIP just says that there is a " photographic/speed detection device evidence". so I suppose it is a camera - does not say which type. There are yellow cameras on that road ( B 4135, Sandwell, W Midlands). I honestly cannot remember speeding consciously as there are cameras there and I was on the way to work (hospital, I am a doctor) so I drove there every day and was certainly aware of the cameras and I watched my speed. But how can I be absolutely sure?

 

I have had a driving licence for 5 years , no points so far and I allegedly drove 39 miles in a 30 mile zone. With regard to this, what is likely to happen? Are they likely to issue a fixed penelty notice of £60 and three points, and should I just accept it or should I contest? What is the likeliness of the camera not being up to standard? Is there a possibility of being offered a driving course and should I accept it?

hi there looking to see if i have any case against this offence. i was driving home from work the road was busy on both sides and the patrol car was accross the road sitting in a cut in, a drove by with my head resting on my hand which was on the window frame, i pulled over about 100yards from where they were sitting to change a cd and they pulled up behind me and asked if a new why they were stopping my i said no and they said they saw me on my mobile. i then told them that i was resting my head against my hand and that i wasn't on my mobile and that i didn't even have my mobile with me. i said that i wasn't willing to accept the fixed penalty and i would be taking it to court but the problem is trying to convince the court that i wasnt on my mobile when two officers say i was. could u give me any advice thanks

I was involved in an accident consiting of me and one other car.

I came round a corner doing around 50mph in a 60 limit, I was not travelling too fast to make the turn in my opinion. As I turned the steering wheel, the car felt light and I carried on going in a straight line. I turned a little more and the back of the car started to slide. As I tried to correct the slide, I collided with an oncoming vehicle. The corner where the accident took place is located near a farm. The other driver agreed that the road conditions were slippery and I also told the police that the road condition was to blame. Do you think the police will prosecute me for careless or dangerous driving?

I have received a summons for a traffic offense which was committed by a driver I am unable to identify. I have a clean driving license.

The car is longer in my possession. This was company car which had my name on the Log Book aslo.

I have co-operated in corresponding with the inivestigating officer and carried out an internal investigation but unable to obtain who was driving the car at the time of the contravention.

I would like to plead my innocence to avoid any further action.

Swapped company bleased van due to mot failure the lease company gave me new van the company I work for are0 trying to establish if I'm covere (wranglinh with ins comp) I was stopped in police check docs to be produced friday 12/3/2010

Do I go in and say no ins and ytake the charge or ask for extension

Truth is it looks like that I was driving uninsured although no one wants to admit it

My brother has been charged with driving without due care and attention. He was riding a motorbike and collided with a car at a junction. My brother said he did not go through a red light but he has 4 witness statements saying he did although he has his own witness saying he didnt...Could you please ring me as I need some advice on this and a solicitor has told me they would charge £2000 to represent him.

My own car is isn't working at the moment, so i borrowed my girlfriends. I have fully comprehensive insurance on my own car, so thought i was covered third party to drive hers. I was then caught on a speed camera on a stretch of road in staffordshire where the speed limit and cameras continually flucuate between 30 and 50 mph. I hadn't noticed that i'd entered a 30mph zone and was still doing 44mph when i got caught on a speed camera. Having now checked my insurance, i've found that, due to the fact that my policy is for a classic car, it doesn't actually cover me to drive other vehicles.

This is admittedly a very stupid, but honest mistake. I have no other points on my license, have never been stopped for any driving offences and have never had a single accident or claim in the 7 years i've held my license. I also have no criminal record.

I'm very worried about what will happen to me for this offence. Will it definately go to court (i'm happy to plead guilty, as i have no defence, except that it was an honest mistake), or can it be resolved without this? I realise that i'm more than certainly going to get points and even possibly a ban, but do you have any idea how much the fine will be?

I have recently had another speeding notice and would ask a little advice based upon your website:-

 

1- The alleged offence took place 17/02/2010, their notice was dated 26/02/2010 – I received it around 03/03/2010 is this beyond the 14 day period in your web case study s.1 RTOA 1988 ?

 

2- The offence is for doing 41mph in a 30mph zone. The road is a dual carriageway with barriers in the centre coming out of Southampton and in all intense purposes looks like and should be a 40mph zone, I am going to take my camera and look for signage tomorrow re the 30 limit and lamp posts

 

3- It was taken by man in a van on the central reservation, in addition to this there was also a fixed camera behind him so if one didn’t catch you the other would – is this allowed so close to each other ?

 

4- I have 6 points already do around 40,000 miles per annum and rely on my license – 9 points would make life quite difficult, the other convictions are Feb 2008 (77 in a 60) & May 2009 (93 in a 70)

 

In essence I am asking – can you help

I have been given a fixed penalty notice, the officer has written the reg no. incorrect, ticked maual box on form when it is automatic and I did not surrender my licence and the officer has made no indication on form as to which police station i should take me licence to. as there are mistakes should I fight the notice in court. I was leeting my girlfriend drive to college to get a bit of experience, she has a provisional but no insurance, we got caught and pulled by the police. Please could someone call me a i have been done for driving without insurance, fined £200 and car was towed away. Insurance was set up back in November along with break down and home contence however system just sowed breakdown and home contence when the breakdown came as a complimentary 1 yr free with car insurance.

I have been stopped and fined by police due to my car not having valid insurance on 15 March 2010.

I was with x insurance and the policy expired on Jan 13th. I honestly didn't remember a) I had to explicitly renew b) the anniversary day of the policy. They didn't inform me of the expiry and didn't propose to renew. It must be noted that I changed address on 7 Dec 2009 but I didn't inform them. Although I had a mail transfer in place to my new address until mid-Jan and I am still owner of the old place so that mail is forwarded to me. X insurance otherwise didn't call me or sent me any email.

Yesterday I called the company to renew my lapsed policy and they refused to do so on the ground that I had no UK license (I have a French one) and because of the potential pending conviction.

Now my car has been taken away and I have 6 points off my license. Are there any special circumstances which could be taken into consideration?

I have a question on behalf of my 86 year old father who has pleaded guilty to driving without due care and attention.

He came out of a side road into the path of a motor cyclist who hit his front nearside door. The motor cyclist filmed the incident because he was an instructor and the police are prosecuting. My father has been instructed to attend court. His faculties are and reactions for one of his age are very good. His health is reasonable and over 50 years of driving he has only had a few incidents. What is likely to happen; is he likely to be banned from driving?

Myself and my friend were going out & he did not plan to drink hence why we was driving. However, he did drink & was highly over the limit & as his friend that did not drink, he asked me to take his car home for him where he could be rest assured that his car would be safe. As the distance was not far, I was stopped by police after about two to three minutes of driving to my destination of less than a mile away. I owned up to driving my friend's car & not having any insurance. I produced my license accordingly and the police escorted the car home whilst I walked to my house. It has been four months since this happened and I am looking for some advice in regards to dealing with this matter, My court hearing is on the 31.3.2010 & therefore, I would appreciate a prompt response. Briefly, accused of speeding via LT2020, I doubt very much I was and doubt the equipment.  There are 3 officers making statements, true and signed, all 3 state that my car is blue, it is in fact black, jet black and shiny to be exact. Even if it was deemed an oversight, would that not seem strange that all 3 officers have the same oversight when making witness statements? OR have they just copied what one of them has written and made a bit up? Is there anything along thelines of collaboration or collusion or even purjery afoot? Summons arrived 12/03 for a date early May. How do I stand and thank you in advance for any help

I was pulled over and asked to go to the officer's car leaving my 85 year old mother alone in my car. The officer did not tell me what he wanted, he made phone calls. After 15 mins (and really a bad attitude and demeaning in a number of ways) he told me I had contravened white lines some miles back and had been trying to stop me on a busy non dualled road.

 

When he told me where it was supposed to have happened I 100% know that

the white lines ended (before the brow of a blind hill) and that I DID NOT

cross those white lines - I have been on that road for 25 years and it would

be suicidal to do so.

 

I am in communication 2x with the professional standards committee and

the fixed penalty decision maker - I am told that he is in the right and I

am in the wrong, now pay the fine. BUT I know he is telling lies and covering

his unprofessional and inaccurate methods and facts.

I have been found guilty of failure to notify information about the identity of the driver.

I was not the driver two of my brothers were using the car they were pointing the finger at each other I could not establsih who it with all reasonable efforts. Took my brothers to court as witnesses. The CPS claimed that they sent two notices and i did not reply to any - True. It wouldn't have made any diffrenece. Offence alleged: Contravention of a temporary maximum speed limit. 61mph on 50

 

Road Traffic Offence question: I was tagged on the M40 on a temporary road works section. I was happy from the start to disclose that i was the driver at the time of the offence, however i requested further evidence including photographic evidence. Warwickshire police wrote back to me saying that i had no legal rights to see any evidence against me. The threat was either plead guilty now without seeing evidence or risk the possibilty of greater fines and points by going to court. I felt strongly that i had the right to see the evidence against me and requested for a court summons. I now have to attend court on the 27th of April. Ironically they have now sent me the picture evidence with the court summons. Anyway i would like to know if the evidence presented stacks up. They have sent 3 images of my car. The images show no relation as to the location or whether this section has any road works. Further evidence is provided by a camera opertor working this section of the M40 stating that the camera was activated and that the equipment was working fine at the time.

Would it make any difference if the section i was photographed in was not active at the time. I cannot recall seeing any work being carried out as the weather was quite poor throughout the day. Would this have any bearing in my favour

Do i have any grounds for a favourable result

I have recently been sent a letter through the post regarding "Undue care and attention". I have been driving for 6 months, and currently already have 3 points on my license for being 0.56s after a red light. I appealed this case and lost.

 

I have got this letter today concerning an incident where

I turned into a road, - with cars parked on both sides. I hit one of the cars on the side. The damage was minimal, their door was slightly dented in, and there were scuff marks on my car.

 

I drove further down the road and contemplated what to do, I finally drove home, and returned to the scene half an hour later and got a friend to leave a note on the window with my mobile number saying: if they wanted to contact me about insurance matters they could do so. I was fairly sure they wouldn't though as the damage was minimal.

 

I am thoroughly shocked that the police have contacted me about this matter, rather than an insurance company, and feel certain that I am going to lose my license. Any advice on understanding the laws further and what to do would be greatly appreciated.

Another driver hit my car and also damaged theirs. We swapped contacts. I called my insurer to report but not to make a claim & discovered they had cancelled my policy; the letter they sent I had not received. I renewed with another company the next day. Since then I have bought a new car. No involvement with the police thus far. The other driver's insurer has written requesting my insurance details under the Section 154 or RTA 1988. They say if I am not making a claim with my insurer they will want me to settle their costs. How should I respond?

My father was reported by a neighbour to the police for straightening the angle of my mothers car on the drive in front of their garage. There was no accident or damage of any kind. My parents called their insurance company who clarified that my father was not insured to drive my mothers car which is a motability car, however he does have a current driving licence and the car was taxed and insured. The insurance company said it is petty and they are not bothered, but the complaint to the police is being investigated and the police have said my father could be fined. Can you clarify the law on private land?

two and a half years ago I had a nervous breakdown which the Doctors sugeested be treated with medication.

 

I had a road accident, the other party became rather nasty at the time so I called the police.

The police breathalysed me (negative) helped me push the car home and let me go (this virtually happened on my own doorstep).

 

About 10 minutes later, they came and knocked on my door and asked if I was taking any medication, I told them I was and showed them the Medication. I was arrested, taken to a police station in NW London, breathalysed again (negative) and shoved in a cell. I was then interviewed by the arresting officers with the FME who decided I was under the influence of drugs. I was bailed to return some 6 weeks later when the results had come back and charged with driving whilst under the influence of drugs. I remember being in a persisitent state of shock after the accident but remember them helping me to move the car and the fact that they had breathalysed me twice at the roadside and again at the station. However, they said nothing of a conversation that they had had with a neighbour who 'thought' I might be taking drugs.

The accident had scared me badly and I became to scared to drive so I surrendered my license myself the following day.

I was bailed to appear in court and as I sat at the back of the courtroom, the CPS handed me their evidence eactly 30 seconds before I was called to appear. I didn't have time to read any of it, I was banned for 12 months and fined £195.

 

Some months later I actually read the evidence and discovered the conversation that the police had had with a neighbour. The Principal arresting officer stated that my eyes were glazed and that's why he'd arrested me.

If the above was the case, why did the police allow me to go home in the first place, why didn't they arrest me as soon as they had reasonable grounds (i.e. immediately) and I don't even recall exactly what I did once I got into my home except that I went to bed in shock.

I eventually re-applied for my licence. When it arrived, the Counterpart showed that I had been charged with code DR20 (Drink Driving) and Zero Penalty points.

They didn't seem to care whether I was still on medication or whether I was fit to drive.

Where do I stand legally having this on my license ? I still have the evidential breathalyser reading slip showing that I had 0 alcohol in me.

the inital NIP did not arrive at my address I did not see the reminder of the NIP until 80 days after the offence on the day of the offence both my wife and myself drove our car several times we were in S. wales sorting out urgent affairs for my 91 year old mother by the time we were made aware of the offence neither of us could work out who was driving, the requested photo provided no clue ( taken from the rear ) we are both in our late sixty's with poor memories can I plead not guilty to the charge as i can only guess as to who was driving and i do not want to be acussed of perjury

I have two sets of three points dated 19.1.08 and 14.8.08. I have just recieved two tickets for 28.2.10 within 1.5 hour of each other one for 35 and one for 37 in 30 mph zone. To loose my licence would be a disaster as I have three children and am a single parent. I would also loose self employed income. Altho I know I have been very reckless and am very aware I have been wrong I would like to know if I can appeal in any way? The offences occured on the way to and returning from an AA meeting ( can prove ) and I have been sober for over three years - I was rushing to meet a newcomer but I again suppose this would not be taken into account? Any advice would be very welcome? Thankyou

I have been driving since January 28th 2008, a month later i recieved 3 points for speeding. On August 30th 2009 at 1.00 am, i pulled up on a zig zag crossing to pick up some mates. I was duly ticketed for this. I have just been convicted for this on March 3rd. This is over the 2 year period since i started driving and am confused as to whether these points should be accumulated with my previous offence? If the points go from the date of the offence, then does my 6month driving ban begin from then as well?

Hi I bought a van on Saturday the 6Th of march and have just been stopped on Wednesday the 10Th of march for driving with no insurance as at that very moment I was stopped my girlfriend was booking the insurance on line, but it wasn't showing i was insured when the police stopped me. they seized the vehicle and told me it will cost 150.00 pound to release the van plus a 200.00 pound fine and six points on my licence. could i appeal this or not?

I have received a Notice of Intended Prosecution for the above offence. It was actually my wife who was driving so I could just return the form with this information. However I have read that the police have 14 days to issue this notice. In this case the date of the offence is shown as 20/02/2010 and the date of the notice is shown as 09/03/2010. This is a period of 17 days. Is what I have read correct and if so what can I do about this?

This is more a question for my fathers piece of mind at present if you could help.

He has 6 points, has also received another nip for an alleged speeding offence calculated from a hand held radar which he feels he should contest.

He was this week taken into hospistal, where he is currently in ccu awaiting an angiagram.

On visiting yesterday I found out he has since received another nip which I believe he aggrees with, though at present he is unsure whether the driver was himself or my mother.

He has not mentioned this last nip to her as yet.

due to his current situation, he is considering taking the further 6points and whatever ban comes to keep stress to a minimum.

Is it possible you could advise on this please?

I was fined £60 and 3 point for allegedly doing 41 mph in a 30 mph zone. I know the road well and I was aware it was 30 mph even though the road is not sign posted. However there was quiet alot of traffic on the road that day due to road works and I am almost positive i wasnt doing 41mph but the police officer who was stood on her own with a camera on a tripod with a no police vehicle or signs on view at all single handed manage to clock me doing 41mph and pulled me in an informed me she had got me doing 41mph then told me to pull in about 50 meter round the corner on the opposite side of the road in a business park where the where two police cars would would give me the ticket. Is there anything I can do to have I really dont think I was speeding, could this be wrong?

I have a comprehebsive insurance with swift cover. i have been told its allowed me to drive other car .also its advising on their advertise. Iwas honestly beleiving and when i stop swift cover told me my occupation is student for thet i am excluded to drive 2nd car under my comprehensive insurance. As a matter of fact they mislead me also when i change my car on 2008 in the month of october they did not put my current occupation . I am not a student but they put my occupation as a student and exclude me from driving 2nd car . I did not have any idea about that.

i was charged in 2007 with refusal to blow a breathylizer and was charged and due to appear in court. i was howeverin the country on holiday and had to leave before my court date back to my country urgently. i contacted the police and i am still in contact with them to make them awear of the fact that i am nolonger in the contry. the police however keep visiting my wife's fathers property as that was address used for my driving licenec. what can i do to stop the visit to her parents home as there is no one residing there currently because its a holiday flat

My fiance is the registerd keeper of an Audi a4 which was reported for not leaving her details at an accident (very minor was a scratch on the vehical in question) now i was driving the car at the time with no licence. My fiance was at home in bed asleep. the police served her with an NIP she advised them she was asleep in bed with my daughter they asked if any body had access to the keys she stated only my self and my partner.. so i went to the station for questioning with a solicitor after the solictor heard the evidence he advised me to say no comment through out the whole interview which i did under guidance as he stated they couldnt prove i was driving the vehical. they have now served my fiance with an S172 - to say who was driving the car to which she has stated she doesnt 100% know for certain - she has asked me on nermerus occasions if i was driving the car she has made other enquieries but has advised the police she cant state 100% who the driver was with out fabercating somthing and giving my name and she stated if she does that it will not be 100% true statment and i wanted to know where she stands with out being able to tell them 100% who the driver was ?

Can she claim or if she shows she has done all she can to find out but to no avail what will be the situation.

I got 2 tickets in the mail today. Apperantly they had a mobile camera for 2 days at the same location. The highway limit drops from 70 to 50 miles and the camera is located shortly after the change. If tickets are suppose to teach you to slow down then why not one ticket to get the message across . Why would they have a camera at the same location 2 days in a row?Can I request to go to school and not get it on my record? 73mph in the 50 zone. Is this even have a chance in court?

It was a hire car. I was probably driving. I recall missing my turning off the A road then turning right, across the road, and into the railway station, then going back along the A road the opposite way. I don't recall any traffic lights. Apparently my recorded speed was 16 (SIXTEEN), mph.

Devon and Cornwall Police say they have photo or video evidence.

Can I ask to see this evidence?

Can I ask to see the calibration certificates?

Can I ask to see where these traffic lights actually are, because I don't remember them?

I was stopped and arrested for drink driving in a Rainbow supermarket car park. I just wanted to know the law regarding driving on private property as a friend has told me that he believes you cannot be arrested for driving offences while on private property. My defence is that I was simply moving my vehicle from the regular short term car park to the long term car park as I realised I was too drunk to drive home but did not wish to be clamped for leaving my vehicle overnight. Does this have any merit?

Last year i received conditional offer for 36 in a 30, i have been driving not quite 2 years if i accept this sp50, 68 in 50 zone offer will i have retake test? i employ 3 guys and couldn’t afford to retake test.

My business would fail if this is forced, is there a way to accept the points, would give me 6 in total and not have to retake the test?

An independent witness says I was travelling at 90 mph but I am sure I was

within the speed limit. I was on a dual carriageway and a car pulled out

from the inside lane straight in front of me. I slammed on my brakes but

hit the rear nearside bumper of the first vehicle then hit a second vehicle

which lost control and ended up on its side in the bushes. Will the court

just take the witnesses word for it that I was speeding?

The accident happened on the 1st august 2009, the weather was extremely wet due too torrential rain which started around 1pm the accident happened at 6pm causing a flood on the road which the accident happened on. as there was cars parked on the other side of the road an approaching car coming from that side forced me to swerve a little causing my car to skid and due to the weather i feel the impact would have been different. The witness statements from the other car have stated that the weather was dry and only started to rain soon after the accident happened. If i could prove the weather would i have good chance of fighting this case?

My girlfriend got disqualified from driving for 12 months due to a tot up of speeding convictions and no insurance.

She finally completed the 12-month ban and I agreed to put her on my car insurance, we went out for a drive at the weekend and she got pulled up for a faulty headlamp on my car.

Upon checking the police found out she had made a mistake and the ban didn’t end when she thought but in fact a week later!!! So she was driving the car three days before her ban actually ended.

It was a genuine mistake; we wouldn’t have added her to the car insurance if we thought she was still banned

She has now been arrested and bailed for driving while disqualified. She is petrified; she is a single mother of two children and is scared stiff she is going to get a prison sentence.

she would of served her 12 month ban three days after we got stopped, she genuinely thought the year was over

I’m looking at a ban because i got high with a letter saying i was

doing 33mph in a 40 zone. Then only days later i received another letter say

that in fact i was not being done for the first thing and i was actually

being done for going through a red light i already have 9 points on my

licence. i really need my car for work as the cost of getting the train

I am 90% sure I was driving a works vehicle that was allegedly speeding.

Am I allowed to see relevant copies of all paperwork relating to the offence, ie camera location, calibration certificates etc before I attend court?

I have informed the officers concerned that I am not 100% positive if I was driving and they have said it will go to court unless I am fully positive I was driving.

Are they trying to frighten me into admitting the offence?

Where do I stand legally in requesting all information before going to court in letters I have written requesting it.

I am pretty sure that I was barely over the limit if at all and want to question the accuracy of the GATSO reading. Should I ask the Police to produce the calibration certificate before the case comes to court? Or should I wait in the hope that they will be inefficient and unprepared and not able to produce it on the day? This is a tactical matter because I realise that the court will assume I am guilty unless a doubt can be cast on the evidence. Are the police generally on the ball in these cases or are they usually able to produce the required documentation on demand?

A police motorcyclist using a police pilot device stopped me. As the case is going to court i have asked the policeman for copies of calibration records and also a copy of his training certificate. I have received a letter to say i should not ask directly for this info. Please inform if i a right to see copies of the calibration records.

I believed my partner was insured 3rd party on my car to drive. So he did once with me in the vehicle. It turns out that my policy did not cover him and he is in court for No Insurance. He has pleaded guilty with special circumstances. However the court wish me to attend as a witness. I am worried that I can be charges with Permitting him to drive. If not you will have to make an exceptional hardship argument to try and avoid the ban. At the time of writing we succeed with these argument over 89% of the time. Could you please advise us as to what he should do. He has only had his

my son has been driving a year. shortly after he passed test he got an sp30 doing 35 in 30 mile limit.Thismade him drive very very carefully from then on. 2 nights ago he approached traffic lights, he knows there are cameras and was not speeding, however he lost his concentration when gears wouldnot engage and clutch was not effective. he went through red light and camera flashed. He rang me and I went out and followed him home about 1 mile. He has had the rac out who have documented a slipping clutch. If he does get a ticket (donot know how long these take to come ) he will have to retake test etc. He is not an irresponsible driver and revoking his liscence will be dreadful. He is at full time uni and has a job. Would the mitigating circumstances help at all if he is summonsed ?

My husband has recently been issued a court summons, can you advise if he is in the wrong.

Whilst driving in zig-zags (delivering for TNT) he wound his window down to ask two policeman for directions. He didn't switch off the engine, he didn't get out of the cab, but they have charged him with 'parking' in zig-zags? I debate whether he has actually 'parked'? Please advise if this is worth pursuing in court?

My son is charged with failing to stop and failing to report an accident. He intended to report the next day within 24 hours, however the police contacted him first, he went voluntarily to the police station and was charged, much less than 24hrs after the accident. The charge says says he didn't report within 24 hours but he didn't get the opportunity. He accepts the not reporting but should he challenge the the 24 hour thing?

I was involved in an accident, i overtook a vehicle while it was clear, a car came round the corner and we clipped wing mirrors. I did not stop because the vehicle i over took did not stop, so I asumed the car i hit carried on going. his was on 15th October, 209. I received a court summons today for 8th aoril, 2010. I have ben told that the police cannot prosecute if it is over 6 months ago. Could you clarify this for me.

the police are saying i was driving with out due care because i turned right at a junction and a car hit the side of me as he was comeing straight across the junction.i got breathallised and showed 0 but im not sure if the over driver was breathalised,the police have gave me no information how to get in touch with them and dint take a statement of the passanger in my car, but they say they have a witness saying it was my fault but they account dosn't tell the true events but i have no witness apart from me and my passenger,this is a brief explantion on what happend and any help you may have would be much appreciated

I've received a NIP for the following offence:

excess speed - 70mph (dual carriageway)(automatice camera device/speed detection device) travelling at 84mph.

The date of the alleged offence is the 24/1/10 and the date on the NIP I have received is 17/2/10.

Q1: Is this enforceable...?

I am supposed to complete the form and send it back but that would mean I would lose my evidence of their NIP being invalid if I were to.

Q2. What should I do next...?

If the Police have not asked me to take a driving improvement scheme can I ask them. I was told by a solisitor that I could not take this for careless driving? Also can I still take it if the court date is set (29.04.2010) But my brother is sueing me for compensation so will it have to court to court. Is there any legal aid as I am on Job Seekers Allowance & currently representing myself?
