I have read that after 5 years I can apply to court to have a DR10 removed from my driving license. The conviction is over 5 yers ago and I have had no offences since that time. Incidently I was only 1mg over the limit (81mg) if this also goes in my favour. Please culd you tell me whether this is feasible?

No offence as or yet. My son has been told that if say you consume 4 pints, if you add on one hour then one hour for each pint, so now that is 4 hours, after that period you would not, in theory fail a breathaliser. I'm worried about this advice. What is your experience on these issues please.

Drink Driving/Possibly without Insurance
Your road traffic offence question: This is on my son's behalf.
He was arrested this evening, and has given a positive breath test. He does have comprehensive insurance however, but there is a doubt as to whether that insurance is valid when driving someone else's car, as he is only 24. Can you please tell me if there is any defense in this case, and if not, what the possible penalties may be?

Hi i was banned for drink driving and have seen my ban out,On trying to regain  my licience i was told because i was banned while still using my provisional licence even tho i had passed my test,that beacuse i hadnt upgraded to my full licence with 2 years of passing my test i would have to retake my test,
i had been driving for about 14 months then banned for 24 months so i strugle to see how i was supposed to apply for my full licence after the point of being banned so it was impossible for me to obtain a full licence after being banned.i have spoke to the dvla about objecting to this but am trying to find out if there is any law that means i cannot get my licince back?mant thanks steve

Your road traffic offence question: i had a accident i hit the car in front of me, I left the scene as i felt threatened by other driver i paniced.. there was a lot of witnesses..i drank half a bottle of wine when i got in - 30 mins later the police got in my property and did a breath test it was 53 the police see me drinking out of the bottle of wine. i was arrested for d/d taken to police st. held for approx 4 hrs then interviewed, gave statement then released on bail - to return within 4 wks - i answered bail and was told to come back 2 wks later as still getting statements etc, been back again 6 wks later from accident date and told to return in a month?? what is happening?

Alleged Offence: drink driving & taking vehicle without permission
Your road traffic offence question: Friday night l took my friends vehicle without permission whilst under the influence of acohol. Crashed the car called the police was arrested. I have to appear a leeds court on x Nov and will be charged with drink driving and theft of vehicle.
Am l banned from driving straight away or from when l get sentenced?
Can l not have my court case heard in stevenage where l live?
How do l ask for leagal aid. I have pleaded gulity.

Your road traffic offence question: my son has 9 points on his licence the other night he had 3 cans of lager in the house then realised his car was on the rode, so he went out to put it in the garage,while he was doing this the police came up to him and asked if he knew one of his lights was not working, my son replied no he didn't. they asked him if he had been drinking and he stated he had 3 cans, they ask him to take a breathalyser,which he did and they informed him he was over the limit and would get 3 points and a ban. these 3 points will take him to 12 points, will he get 2 bans, one for 12 points and one for DUI.

I was in a petrol station, filled my car then paid for it at the shop and the came toward my car. Police van pulled over as I was going inside the car before I started the car. I have given a breath test.
Please note I was away from vehicle over 10 mins and there was no road traffic offence.
Q1. Should this offence be "In charge of motor vehicle when alcohol level above the limit" [DR40] rather than "Drive motor when alcohol level above limit" [D10]?
Q2. At the time of test i was 61 mg in breath but when i was tested approx one hour later in the station i was 73mg. Which one should i be getting prosecuted for 61mg or 73mg?

Your road traffic offence question: I was charged with failure to supply analysis in x 2010(date of offence x)& pleaded not guilty due to medical reasons. I was banned for 17 months. I have since completed a TTC course. I am x months pregnant & have several personal circumstances which mean life is very difficult without use of a car. I have asked the magistrate if they can reduce my ban/start it from the conviction date however the magistrate legal advisor has said there is no clause to enable the magistrate to do this as she sure they would be sympathetic in my case. Surely if they have the power to take my licence they have the power to give it back?? She said the only way to do it is to appeal which I cannot do.
Is there any clause/policy that they can reduce my ban/quash the conviction or start the ban from my conviction date if I pleaded not guilty??

I found your details on the internet following some research on my sentence. I am currently serving a 3 year ban having been banned drink driving for the 2nd time. I was caught again 9 months into my original first 18 month sentence and given another three years. 2 have now passed and having grown up a bit am doing well in a new job with possible promotion coming shortly. Would I be eligible to apply to the court to get my license back early? I successfully completed the DIDs programme and had my supervision dropped due to good behaviour. Having gone through a tough year in x I have got my act together with a very good job and need my license back to progress with the company. Having worked hard in school and university I am ready to put all this bother behind me once and for all and hopefully take this iopportunity available to me.  Any information you could provide me with I would be more than grateful.

If an inlaw was driving the car at the time of the accident (no witnesses available or other car involved) with the accused (owner) as the passanger and the police came busting through the house door some 3 hours later (without warrent causing 1600 pounds of damage to the doors. and charged the owner who by that time had suffered trauma and had been driking heavily - lost all confindence in the police due to their actions and the initialy appointed solicitor was not approachable (as he has a duty to the court) with one fact as to who the driver was as there would be repacutions on "spilling the beans" and the accused works away from home so he cannot be there to protect his family from the almost sure backlash that would follow. If the accused did not commit the offence but cannot name the driver for this reason and tells this to the solicitor is the accused in worse trouble for being as honest as could be? Would it be better not to mention it or go to another solicitor. Please advise as the accused is facing a conviction of drink driving which was not commited.

Your road traffic offence question: recently went to court and got sentenced 2 probation and a 3 year ban 4 the above afences,i was allowed 2 drive with a provision licence,but got in to a fight and knoked out so i jumped in to the car and drove about 100 meters up the road to get out of trouble.at that point the police turned up and i was stood outside of the car.they arrested me for diqualifyed driving amd failing to give a specimin.saying that a scurity gaurd gave a discription of me,an also told the police that i had been hit over the head with a crash helmet.is there any thing i can do to get my licence back,i work as a vehical tecnision and my mom is disabled,with this ban i will lose my job and home and be homeless with my mom and wife.i know what i did was stupid but had no other choice ,i had to get away or would have severly got beaten .please can u give me advise,cuoldt the court have give me a suspended ban ,could i still go back and as 4 that.i do have history of driving whilist,but have not been in trouble for over 8years.please help me other wise me and my family will be home less u now haw hard it is to get a job

I have been banned for 12 months for drink driving.I was told that this was the minimum sentence they could give me under the cercumstances. I had a letter from my doctor letting the court know about my wife's lung disease and other pressures That I was under.
I have now lost my job because of the ban as I cannot do the role without driving. (I was a x in the Construction Industry.)I will now lose my house as I cannot pay the mortgage. This will affect my three children and my disabled wife. Not only will we lose our house but also the house that we bought for my wifes parents, so they could be near her. I know that what I did was wrong but can I appeal for the sake of my family? The court hearing was on the x/10 and I have been informed that I should have appealed within 21 days.
Is there anything that I can do?

My son was charged with drink driving his reading was 54 he was caught moving his car from a main road to a car park at 5 am in the morning so he would not get a parking ticket there was no other traffic about the police were behind him for less than a minute before he was arrested and breatalized. He needs his licence to be able to work because he drives all over the country. on the same day he had an offer accepted on a property and his mortgage application was approved. If he looses his job he will have to pull out of the purchase.

Firstly I would like to say your web site is great and it's good to see that your making a challenge against the extraordinary erosion of one of the few civil liberties I never thought would be attempted by even the most vile of British governments that of the right to a qualified legal defense.

My story is this I've started the proceedings to try and avoid disqualification on the bases of shortness of distance. I have spoken briefly to a solicitor who has told me that my case does fit the seven set criteria  that allow me to be considered for such a hearing however it does not look as though I will qualify for legal aid.

I might be able to get the money together so as I can have a solicitor for just the hearing but even this will be difficult so I may have to represent my self.

My question is this is there any where that I can any advice on proceedings and  questions that I need to ask or points I need to get across etc...  or how would you feel the best way for me to proceed is.

Your road traffic offence question: It seems to me that the sentences handed down by Courts are inconsistent. I was given a 2 year ban, reading of 113mg (which I know is very high) first time offence and no other criminal convictions but was refused the opportunity to do the rehabilitation course. I feel that equal rights have been breached; surely this course is beneficial in raising awareness to EVERYONE and should be available to all. I'm totally remorseful for what I done, I made a GRAVE mistake but fortunately no one was hurt. Surely anyone caught for the first time on their first offence should be given the opportunity of this course. Can there be a challenge lodged against sentences, should they not all be consistent. Seems to me the rich folks get the lesser sentences!

hi what it is i was banned in december 2009 for 3 years the problem is my father had a stroke about six weeks ago and lost his sight in the corner of his eye and could lose his lisecne and we work together he drove me to work becauce i was banned but know he could lose his lisecne we would both lose are jobs i know that this might not work becauce ive only been banned for six months iv done the drink drive course as well just need some advise thank you

I was charged and convicted for excess alcohol and given a 30 month driving ban from x  2009. I agreed to attend an approved driving course, (which would take 7 months off the ban) Given one year is almost up, can I appeal to the courts to lift the balance of the ban? Reasons being, travel to/from work, hardship, ill health, absitance since x 2009, Community Order being Revoked on Good Progress and successfully completed alcohol rehabilitation.

Hi there, i have been done for drink driving, Failing to stop, no MOT and no Valid insurance i got baned for 20 months lowered to 15 due to drink driving course i took, i have currently served 7 months of my ban, is there anyway i can appeal to get my licence back any earlyer due to my grandparent being disabled and having to get to and from hospital 3 times a week and no other family members able to give him a lift. any info would be great, many thanks

I was arrested for drink driving and recorded 49 for the first breathlizer and 50 for the second.
the policeman said i can have a blood test or a urine test. i asked what difference would it make? he said he couldn't answer the question i am scared of needles which i informed the officer and said i but dont mind doing a urine sample. He said he chose which i had and that his decision was for me to have a blood test.
i explained about my needle phobia
i am 18 i dont normally drink at all and only consumed 1 can of heinkein at a friends birthday party which is extremly rare. i cannot understand why i was over. i have been suffering from heartburn and indegestion due to the "maximuscle" mixture i have been taking as part of an intensive gym work i have been doing i dont know if that has played apart in my digestion, but i am confused and baffled as to why i would be over the limit with 1 can of heinkein.
iwould like some advice as how to proceed
am i eligible for legal aid? will it affect my A levels as i am due to take my final exams in a few weeks and will attend Birmingham university in September. i am very worried as to the consequences and possible criminal record

i was caught driving 4 weeks ago by a police check point. the officer asked could he breathilise me at the scene which i obliged to altho i explained to him that my mother was ill and that i was on my way to check on her. I failed the breathaliser and so was taken to the local police station, i was breathalised again and my reading was 58, i explained again my situation regards my mother and also that my own health has not been good and that i had lost 6 stone in the last 5 months and that i was on pain killers, also that have a disabled son who has been in and out of hospital over the last few months and was worried about losing my licence as i am my mothers only relative in the country and she deoends on me. i was honest with the police and admitted that i only had 4 shandys, could you please give me some advice on what i should do.
