Driving without an MOT

Hello Emma Patterson,
We are a RRRA member and I read with interest your recent artical in the RRRA news.
I recently received a non endorsable fine of £60 from a police officer that was parked on a Tesco petrol forecourt. Basically I drove into the forecourt, filled with fuel and noticed him watching the vehicle. After I had paid I returned to my car and as I approched it the officier advised me that the MOT was out of date by seven days.
He had checked and the car was insured and taxed, but an oversight had been made on the MOT. My question is can they conduct this on the forecourt or should I have been stoped on a public road to be issued with a penaulty notice.
Any thoughts from yourself would be greatly appreciated.

I live in Somerset & collect vehicles for my son who has a garage in Cornwall. The cars are collected from auction sites & driven on Trade Plates. The auction sites can be anywhere in the country, but one used is located 15 miles south of my home between Somerest & Cornwall. Am I permitted to drive such a car if it has no current MOT from the auction site to my home prior to onward journey to Cornwall or must it be driven direct to the garage site. The car would be stored off road at my home. Would the direct drive from auction site to garage site apply in all cases irrespective of where the auction site is.
