Defective Ticket

Question:

I was issued with a fixed penalty notice last night for doing 44.97 in a 30 limit. I have noticed this morning that the time of offence on the notice is wrong.

It was an hour earlier than it actually happened. Would you advise contesting in court or just cutting my losses and paying?

The only real issue if you take it to court is whether or not you accept that you were speeding at the time of the alleged offence. If you don’t and you can cast a doubt on that suggestion you will defend yourself. If not you will get higher fines and court costs.

If you accept the speed then accept the ticket. A defect on ticket of this nature is not a defence I’m afraid. The ticket is not the officer’s evidence.
