Speeding And Racing At The Same Time

Question:

I was driving along a 40mph road when a car speeding overtook me. The police were coming out of a side turning and have said that I was racing and have estimated that I was driving between 60 and 70 mph which I was not.

As there were two policemen in the vehicle I have been advised to plead guilty, even though they also put me on the wrong road. What would you advise?

Louise says:

You cannot be convicted based on the uncorroborated evidence of one police officer. If there are two police officers then they can back each other up.

You can still contest the suggestion that you were racing – which is quite a serious aggravating feature. It would definitely be better to be sentenced without any suggestion of racing it could make the difference between a driving ban and no driving ban.

Have you got any penalty points already? Are you a new driver? Tell me more and I will assist further.
