Mobile phone offence - car not moving at the time!


any chance of avoiding the 3 points penalty ....the time police spot me i was stuck in a traffic and car was not moving...so please let me know many thanks

The offence requires that you were using a mobile phone whilst driving. Driving is defined as both motion and control. If you were stationary at the time then you may be able to defend this matter - but if you were creeping along in a queue of traffic then you will struggle.

 

Have you got any points on your licence? If so how many?

 

Come back to me if you are up for a fight and you are adamant that you were not moving.
