I was using the phone but I was not driving.
My wife, on her way to work, pulled over to call work and tell them she would be late.
A police officer knocked on the window of her stationary car,engine was still running, and told her that she was guilty of using a mobile phone whilst driving. She was fined on the spot £80 plus 3 pts on her license.

The fine would normally be £60 and 3 penalty points.
Using a phone whilst stationary in a car is not an offence. The police have to prove that she was "driving" whilst using a phone for her to be found guilty.
