My car wasn't in that place at that time.
The time on the NIP is incorrect. There is a possibility that I did run the red light, however at the time on the NIP I can prove that I was elsewhere.
I returned the s.172 and said I was unable to identify the driver at the time on the NIP. I have now been contacted by the police and asked to view photographs and to bring my car for verification.
Have I got enough of a reason to argue the NIP, and if so how do I go about it?
An invalid NIP is not a defence to failing to name the driver so be very careful with this one.
The police have to prove that the offence happened at that time in that place otherwise the NIP will be defective and you will have a defence to the red traffic light offence.
Your defence to failing to name the driver would be that it wasn't practicable (possible) to name the driver because the car was not in that place at that time.
