Red traffic light - new driver revocation...


my son has been driving a year. shortly after he passed test he got an sp30 doing 35 in 30 mile limit.Thismade him drive very very carefully from then on. 2 nights ago he approached traffic lights, he knows there are cameras and was not speeding, however he lost his concentration when gears wouldnot engage and clutch was not effective. he went through red light and camera flashed. He rang me and I went out and followed him home about 1 mile. He has had the rac out who have documented a slipping clutch. If he does get a ticket (donot know how long these take to come ) he will have to retake test etc. He is not an irresponsible driver and revoking his liscence will be dreadful. He is at full time uni and has a job. Would the mitigating circumstances help at all if he is summonsed ?

He will get a notice within 14 days of the alleged offence if he is the registered keeper of the car and if they decide to prosecute.

If he takes the ticket his licence will be revoked.

His only chance is to reject the ticket and ask for a court hearing. he will then have a special reasons argument based on mechanical defect. If the court agree then he will avoid the points and revocation.

I feel confident that he will have a good chance in relation to this matter. the CPS may even agree to withdraw the proceedings if we show them the evidence from the RAC.

This wont be an easy argument to make but he has a good chance of succeeding.
