Sorry for the delay. You can be convicted of driving without due care and attention even when there is no accident. the allegation can be based on speed and the prevailing road conditions. The allegation cannot be based on speed alone.
Have you got any points already? Have you got a summons to court? The magistrates tend to take these allegations very seriously and see the speed as an aggravating factor
