Unmarked police car speeding allegation?


My partner has recieved an NIP report date of 11th Feb, whilst driving a hire car, ( so the 14 day rule dosent apply ) But she was not stopped or caught on cam, the only thing she can remember is a plain white vauxhall hatch, on the M40 overtook her with 2 young men in, in plain clothes, and one of them waved a card at her. Can you advise if this stands.

It maybe that it was an unmarked police car. It would be a good idea for her to ask if they have any photographic evidence and if not what the nature of the evidence is. They have to supply the photos if they have them. If they don't then they don't have to tell you much at all.

 

Your partner needs to identify herself if she was the only potential driver at the time. This will avoid 6 points for failing to name the driver. Its not an admission that she committed the offence. Do you know what speed they are alleging? The police will have to prove beyond reasonable doubt that she was speeding at the time of the alleged offence. If she can cast a doubt she will win. Its difficult to advise on the reliability of the police evidence without knowing what method of speed detection they used.
