Illegal police stop - no insurance
Do the circumnstances in which the police pulled over the driver have any bearing on the charge of driving without insurance. ie could the driver claim that the police had no right to pull over the vehicle at the time?

You may have a complaint to the IPCC or an argument that the police acted outside of their powers, but it wont be relevant to the issue as to whether or not you had insurance and that's all the court will be interested in Im afraid.
The court wont agree that the evidence of no insurance is unreliable because you were stopped unfairly...
