Fixed penalty - wrong offence code?


Have been issued fixed notice penalty for the above offence, which I thought, was Offence Code CU80, but they have used Code CU66. Is this the right code to use? If they have used wrong code can I get notice cancelled?

Answer:

No. The notice is only an offer of a fixed penalty. The offence code is neither here nor there in relation to the evidence in the case.

The only time that you can defend this matter is if you weren't using a phone whilst driving. If you challenge this matter the officer will come to court and give evidence that you were using the phone, if you can cast a doubt on that you will win.
