Can I see the photos?


I have notice of penalty to which I have not yet responded

On the morning in question, more than one person was driving my vehcle - the time of alleged offence it could have been one of two persons. The notice does not advise in which direction the vehicle was travelling. Am I in order to ask for photo evidence to identify who was driving and ask in which direction vehicle was travelling?

What happens if photo then unclear & I am genuinely unsure who was drving?

You can ask to see the photo evidence. The police guidelines suggest that they should send it out. It will probably be a photo of the back of the car and it probably wont help.

You will then have to show that you have used reasonable diligence to name the driver in order to defend an allegation of failing to name the driver.

I can help you with this matter. We have almost a 90% success rate in dissuading the police from taking these matters further when our clients cannot figure out who was driving at the time and I will be happy to assist.

If the matter goes to court you will be at risk of 6 points so keep a record of all your efforts. Name the other potential drivers and provide their contact details and make sure they are insured.
