Totting bans penalty point ban
Jun 7, 2010
I didn't accept the speed alleged - what next?
i was pulled over on the x i got out the car and was cautioned straight away, but not told what for!. I was asked for my licence but i didnt have it on me at the time, neither insurance certificae or M.O.T. I then got taken to the boot of a police car, at that point i was shown the speed gun and asked was you doing this speed? i said no, because i wasnt doing over the speed limit (50), i then asked for a callibration test certificate, and the officer ignored me, and carried on writing in his pocket book. i was then asked to sign something without it being explained to me, so i refused. Then i got sent on my way, but was not given any fixed penalty notice or producer. what can happen now. i also have 9 points on my licence please get back to me asap. Many thanks

You are going to get a summons to court Im afraid and you will be at risk of a 6 month totting ban. You will be able to try and defend this matter but you need to make sure that you have a very strong argument otherwise you will just succeed in antagonising the court if you lose and they wont have much sympathy when it comes to arguing exceptional hardship.Do you need to be able to drive for your work. Tell me more.
I help over 92% of my clients avoid totting bans and I will be happy to assist further.
the officers couldn't offer you a fixed penalty because you had 9 points already and because you made it clear that you didn't accept the offence alleged.
Come back to me if I can assist further and I will call you to discuss.

Do not use online letter packs that claim to "Get yourself off a Speeding Ticket - Guaranteed!"
No two cases are the same. You must not mislead the police. A pro forma letter is not necessarily going to be relevant to the cirmcumstances of your case.
The road traffic police have seen them all a thousand times before.

This case represents our toughest battle to date. It was a battle at every stage involving Magistrates, District Judges, Court Clerks, Cps lawyers and Crown Court Judges. The argument was all about whether a road was public or private.
