38 in a 30 speed limit
I have been issued a summons for speeding on a road "Ax I was not on that road at any time during the date in question x2010. However I was on a road approximately 7miles away where I saw a ploice motor cylce with a speed camera approximately 300yards into a 30 mph. Can they still prosecute me

That's odd. The officer has probably made a mistake regarding the name of the road. If you got a NIP in the post and named yourself as the driver then you maybe able to argue that the NIP was defective as it has to be really precise as to the location of the alleged offence. Have you seen the officers statement? Does the officer repeat the mistake or is the mistake only on the front of the summons? If the officer's hasn't made a mistake and its just a mistake on the front of the summons then the prosecution will be allowed to amend the summons to the correct road. the key is who's mistake was it.
