Wrong camera?


I have been served a NIP for speeding. I was actualy flashed by a different camera than stated on the NIP. Does this constitute an incorrect prosecution?

The NIP us supposed to outline the location, date, time and place of the alleged offence and a brief outline of the offence itself. If the NIP describes the location incorrectly by referring to the wrong camera then you may have an argument. This does not give you an excuse to fail to name the driver...It simply allows you to possible defend the speeder after station that you were the driver at the time.
If you think they made a mistake call up the safety camera unit and ask them whether to not they can explain the mistake. they might actually be right and you may be mistaken.
Keep me informed of what they say.
