My tacho says I was doing 15 mph 1 minute before.


I have been photographed doing 39 mph in a 30 limit. I was driving a lorry, one minute before the photo was taken I was doing 15 mph according to my digital tachograph. The mobile van was on the opposite side of the road facing away from me and took a picture of the rear of the vehicle. Can I appeal ?

You won't be able to persuade the police to drop the fixed penalty ticket.

The only way that you will stand a chance of avoiding the penalty points is to reject the ticket and ask for a court hearing. Art court you will have to persuade the magistrates that the officer's evidence is unreliable. The evidence from your tachograph may help but it is not conclusive. The magistrates may form the view that you then sped up and by the time you passed the camera you were doing 39.
