Mobile phone - not!
I was sitting at a set of traffic lights with handbreak on, another passenger in vehicle, had my sat. nav attached to the windscreen, leaning forward to turn it off the police passed and waited round the corner and pulled me over, i got 3 points and a £60 fine, it has not gone to court yet and i,m wandering if they can do this as i think it is unfair to charge me as i was stationary,

If you have accepted the fixed penalty then Im afraid its too late to do anything about it./ Its not an offence to touch the sat nav when driving but it is an offence not to be in proper control of your vehicle.
Have they given you a ticket for not being in proper control or for using a mobile whilst driving. If its for using a mobile then you have an defence obviously.
Come back to me if you would like my help with this matter. Bear in mind if you take it to court and lose you will get higher fines and court costs.
