Using a Mobile Phone
Jun 30, 2010
Just looking at the clock
an un marked police vehicle saw me holding my phone in my right hand and said i was pushing the buttons and pulled me over. i did not use my phone to make/ recieve and calls or text messages. i was very nerous and told the police offcer that i took it out of my pocket and whilst moving it i just looked at the time. i wrote toorange and they sent me a confermation that no calls or texts were made but only the police or a solicitor could ask for the information if any calls were recieved.

That tends to be correct. they will normally only reveal the calls/texts received if we threaten to get a court order.
If you intend to contest this matter I will be happy to assist. You have to be using the phone for telecommunication purposes whilst driving. looking at the clock or simply holding the phone is not an offence.
