Using a Mobile Phone
Jul 7, 2010
I was fiddling with my blue tooth..
I was accused of using a mobile phone while driving. I was not I was adjusting my blue tooth ear piece.
They have not issued me with court dates as this is what I requested. Is there a time limit for them to do so.
Many thanks

The court proceedings have to be issued within 6 months of the date of the alleged offence.
When did the alleged offence happen? Have you got any points on your licence already?
You have a good defence to this matter if you were not actually holding the phone at the time. Were you on the phone - albeit through the blue tooth?
The officer will probably claim that he saw you holding your phone up against your ear - did he suggest this at the time he stopped you?
Tell me more.
