Getting phone records
My boss has been stopped by the police for useing a mobile phone whilst driving, he was not useing his phone but did have it in his hand. The police say he was useing it and have sent him a court date, we have our bill from Vodafone that confirms he was not making calls but they say they can't give us incoming call records. How can we make Vodafone give us these records as we know they must have them for us to prove our case in court.
Can you help please.

Has you boss got a hearing date at court yet? Has he got any points on his licence already? If so how many?
You will often have to threaten the mobile phone provider with getting a court order for disclosure before they will reveal details of incoming calls and texts, but it is possible.
Would you boss like to be represented? It's not going to be easy cross examining and trying to undermine the evidence of an officer.
Come back to me if I can help further.
