Just received two really old NIPs


Alleged Offence: speeding
Your road traffic offence question: I have just received two NIP's both dated x/10/10 for offences on x july and x Aug. This seems a long delay! In the earlier one, I genuinely can't say whether my wife or I was driving, so how can I honestly answer part 1 or part 2 of the NIP.regards.

Are you the registered keeper of the car in question? If not the 14 day NIP rule does not apply to you Im afraid. the 14 day service requirement only applies to getting the NIP to the registered keeper of the car. If its a lease car that wont be you...
Tell me more about that issue.
You have to tell the truth in your response. If you don't know who was driving and it could have been you or your wife then you need to name both of you and explain the difficulties that you are having.
The police could summons you for failing to name the driver. You will then have a defence if you can show that you have done your best to figure it out.
Failing to name the driver carries 6 penalty points so you have to be careful
Have you got any points on your licence already? If so how many?
Can you tell me the speeds alleged in each case. These issues will affect your credibility with the police.

Do not use online letter packs that claim to "Get yourself off a Speeding Ticket - Guaranteed!"

No two cases are the same. You must not mislead the police. A pro forma letter is not necessarily going to be relevant to the cirmcumstances of your case.

The road traffic police have seen them all a thousand times before.

This case represents our toughest battle to date. It was a battle at every stage involving Magistrates, District Judges, Court Clerks, Cps lawyers and Crown Court Judges. The argument was all about whether a road was public or private.
