I Only Broke The Speed Limit To Get Into The Traffic On The Main Road

Question:

DRIVING WITH CLEAN LICENCE SINCE 1978. USING SPEED LIMITER ON CAR SET AT 35MPH (MERCEDES CAR) COMING OUT OF A VERY BUSY JUNCTION AND ACCELERATED OUT TO GET INTO FLOW OF ONGOING TRAFFIC SPEED.

SLOWED DOWN AS SOON AS SAFE TO DO SO. ONLY SPEEDING FOR A VERY SHORT DISTANCE AND CONTINUED WITHIN SPEED LIMIT. CAN YOU HELP?

Louise Says:

If you accept that you reached 40 mph (not matter how briefly) then I am afraid that you are not going to be able to defend this matter. You only have a defence if you can cast a doubt on the suggestion that you broke the speed limit.

Needing to speed up to get into the flow of traffic is not a defence I’m afraid. The court will find that you should have slowed down and awaited someone letting you in within the legal speed limit.

Sorry. I think you should take the fixed penalty unless you deny the speed. In which case come back to me.
