No Fixed Penalty Offer For Using Mobile Phone?

Question:

I have just been caught using a mobile phone whilst driving. The officer took my details and got me to sign his notebook but didn’t issue me with a fixed penalty offer or caution me. Does this mean I will get away with it or will I receive a fine through the post.

The officer would normally give you a fixed penalty offer. Did you deny the offence? If so the officer will ask the court to issue a summons within the next 6 months?

Have you got any points already? If you have 9 points then the officer wouldn’t have been able to give you another three and therefore would have issued a summons to court because you are at risk of a ban.
