My son was stopped by the police and given a FPN for what they said was a tyre with insufficient tread…This was purely by looking at the tyre in the dark with a torch,the tyre is I except borderline but could not be clased as illegal without a tyre gauge. Am I right on saying that in court they have no evidence to prove the fact?

You would have to cast a doubt on the officers evidence in order to win this matter at court. I would suggest that the only way you could do this would be to take photos and get the tyres inspected at a garage ASAP. Otherwise the officers will give their evidence at court and will moist likely be believed.
