Speed Detection Device Not Working Properly

Question:

I was stopped by traffic police supposedly going 49mph in a 30. Firstly from the time the police could have taken a reading with there hand held device to the moment I was stopped was less than 0.2 of a mile.

Secondly when the officer showed me the device it is was blank, she then pushed a button a couple of times and then said I was doing the speed mentioned above. What is your opinion please.

Have they offered you a fixed penalty or told you you’re are going to be summonsed to court.

I anticipate they will summons you to court where you will be at risk of 6 points or a short discretionary ban.

The officer has to prove to the court beyond reasonable doubt that her evidence is reliable. Its sounds as though her evidence maybe a little ropey – but I am sure that her statement will suggest that all was well with the device…! She also has to prove that she formed the opinion that you were speeding before she used the device to check.

You will struggle to defend this on your own. You have to cast a doubt on her evidence to win.
