Direct Debit Failed – Moving Banks

Question:

I was stopped on x for not having insurance. I was adamant I had as I had recently had my renewal docs stating take no action as it will just continue. Police gave me a producer.

I took my docs in and police said no actual cert so I contacted insurance company who advised they had written to me regarding unpaid direct debit (I was moving banks) and cancelled my policy.

They state they wrote to me 3 weeks before they sent renewal docs. I produced all docs on x and police were sympathetic as subsequent letter indicated I was insured. It is now more than 6 months since the actual offence date and I have heard nothing. Is it likely I will still be charged?

Don’t breath a sigh of relief yet. They have up to 6 months from the date of the alleged offence to issue the summons. Sometimes they issue the summons in date and then take a month or so to send it out in the post.

Wait another couple of months before you relax completely.

If you do get a summons, and I think you probably will, then you will have a special reasons argument if the direct debit failure was not your fault.
