Driving Without Due Care And Attention

Question:

The police are saying I was driving with out due care because I turned right at a junction and a car hit the side of me as he was coming straight across the junction.

I got breathalysed and showed 0 but I’m not sure if the over driver was breathalised, the police have given me no information how to get in touch with them and didn’t take a statement of the passenger in my car, but they say they have a witness saying it was my fault but their account doesn’t tell the true events.

I have no witness apart from me and my passenger, this is a brief explanation on what happened and any help you may have would be much appreciated

You are going to be at risk of 3-9 points and a fine I’m afraid.

It may be possible to defend this matter if you had right of way. if you didn’t it may be possible to get you on the driver improvement course as an alternative to prosecution.
