HGV – Traffic Light Offence

Question:

Got a notice of intending prosecution today for failing to comply with a red light and I called them and was told that I had been doing 25mph and had gone over it by 1.6 seconds. I drive a 33ft HGV lorry. Is there any way I could successfully appeal this?

You can only appeal this matter if you feel that you can cast a doubt on the allegation. If you accept that you crossed the stop line when the light was on red then you should take the fixed penalty offer because it will be cheaper than taking it to court.

You could only avoid the points if you could defend it or if you could show the court that there were special reasons for the offence – for example an emergency.
