Illegal Police Stop – No Insurance

Question:

Do the circumstances in which the police pulled over the driver have any bearing on the charge of driving without insurance. i.e. could the driver claim that the police had no right to pull over the vehicle at the time?

Paula Says:

You may have a complaint to the IPCC or an argument that the police acted outside of their powers, but it won’t be relevant to the issue as to whether or not you had insurance and that’s all the court will be interested in I’m afraid.

The court won’t agree that the evidence of no insurance is unreliable because you were stopped unfairly.

Do you want to tell me what happened? Have you got any points already? You risk 6-8 for driving without insurance. What had gone wrong with the insurance? If you tell me more I may be able to help further.
