Insurance Cancelled – Proof Of No Claims

Question:

First time I have been stopped for having no insurance.

As far as I was concerned I had taken the insurance out and paid in full one go.

What happened was that the company cancelled my insurance last month as they wanted my No Claims Bonus proof.

They wrote me to ask for it but were writing me on my previous address which I was never receiving, they wrote about the cancellation also as they say but at my previous address.

They had my new address but they say they had the previous address as my correspondence address.

Now I have been issued a HO/RT1 form to produce the insurance at the police station in 7 days.

Never knew they had cancelled the insurance.

Will I be given the option of a fixed penalty or summoned to court ??

You would be surprised at how often this happens. What happened to the premium money?

You are at risk of 6-8 points but if you had paid the premium in full you have a good special reasons argument. I think the court will agree that it was reasonable for you to think that you were covered albeit they will want an explanation regarding why the insurance company had the wrong address.

If they agree there are special reasons then you will avoid the points and probably get a discharge rather than fines and court costs.

You may be offered a fixed penalty – but they normally do that at the time they stop you. If they didn’t then you will get a summons to court. have you got any points already? If so, how many? How long have you been driving?
