Just Switching The Phone Off

Question:

My father gave me a loan of his mobile in case of emergency. It was, as my one was on charge, it suddenly went off in the car. I picked up the phone to try and switch it off as my one usually is and suddenly a police car pulled out at the side of the road.

I have been fined £60 and 3 points as I have ADHA I didn’t realise it was a text to my dad from my sister. Was this an offence or can I do anything about the points and fine?

Simply trying to switch the phone off does not amount to using it. You should be able to show that you were not actually making or receiving a call if we can get your phone records.

If you don’t accept the offence then you need to reject the ticket and ask for a court hearing. If you lose at court you will get higher fines and court costs.
