Do I Have To Name The Driver?

Question:

I’ve just received a notice of intended prosecution 81 on a 70mph dual carriageway. Demanding that I identify myself as the driver. Is there anything I can do to fight this?

You must simply tell the truth in your response.

If it was you then you must say so otherwise you risk 6 points for failing to provide the information. If it was not you then you should name the driver and provide their full contact details.

This is not a confession to the speeding matter and if you deny that you were speeding at the time then you need to reject the fixed penalty offer that will follow and take the matter to court.
