Name Wrong On NIP

Question:

83 in a 60

I have been driving 28yrs and have 3 points from 3 yrs ago. I was driving my car which I have owned for 4 yrs, but on the NIP letter my name is spelt x is this a possible legal loophole to avert a fine and points ?

Rob Says:

You could argue that the NIP is defective on the basis that it has not been sent to the registered keeper of the car. You can only raise the argument if the mistake is that of the police and not that of the DVLA.

If the DVLA have the name wrong on the v5 for the car then the police will be able to successfully argue that the NIP was sent to the last know details of the keeper.

Is it the mistake of the DVLA or the police?
