Officer Not Following ACPO Guidelines

Question:

While traveling on a63 Leeds I was allegedly caught by a hand held device the police officer was parked on a roundabout on chevrons directly behind central reservation barriers.

He was aiming device from drivers seat through passenger window when there are purpose built police bays 100 metres away giving him a much clearer view of the carriageway I have looked at the ACPO guidelines and he doesn’t seem to have followed any of these do I maybe have a defense

You only have a defence if you can cast a doubt on the speed alleged. The issue as to where the officer positioned himself will be irrelevant as far as the magistrates are concerned I’m afraid.

If you accept the speed alleged then you should take the ticket. The ACPO guidelines are just that. Guidelines. They do not form part of the statutory requirements for a speeding offence.
