Photos Are Not Clear

Question:

Excess speeding section 1

I don’t know who was driving my car whether it was me or someone else and the camera photos are of my car, you can’t see who is driving the vehicle. So do I have to take the points?

Dominic says:

If you cannot name the driver then you risk 6 points for failing to name the driver I’m afraid.

You can avoid these points if you can show that you have done your best to figure out who was driving at the time – used reasonable diligence.

It’s a risk to take the matter to court on this basis unless you are clear that you cannot name the drive and there are other realistic possibilities as to who was driving at the time.
