Probably My Girlfriends Fault – Due Care Offence

Question:

My girlfriend had an accident in our car this morning, colliding with another car when she was coming out of a junction. It was probably her fault and she admits she was tired (happened at 6.45 am).

She has been charged with driving without due care and attention and we are waiting for a letter to see if we need to go to court.

If this happens, what is the likely outcome? No one was hurt but the cars were pretty badly damaged. Will she have a criminal record if convicted?

If she gets convicted then she will have a criminal record but most people don’t take too much notice of road traffic offences.

If she gets summonsed to court she will be at risk of 3-9 points and a fine. Has she got any points on her licence already? If so how many?

I maybe able to persuade the police to let her do the driver improvement course as an alternative to prosecution. Out of the last 60 cases that we have taken on at this stage only 5 have resulted in a court summons.
