Not In Proper Control Of A Motor Vehicle

Question:

I was using a toothbrush to remove something stuck in my teeth. Less than 30 secs. People smoke while driving is there a difference. Could i appeal against the three points?

Emma Says:

I take your point entirely. Simply holding something in your hand and lifting it to your mouth cannot be an offence if people are allowed to smoke and drive at the same time.

The police would have to show that not only were you using the toothbrush, but that you were not in proper control of the vehicle and that you did not have a full view of the road ahead.

If you reject the ticket you will get a summons to court. At that stage I may be able to get the case withdrawn for you without the need for a trial.

You have to appreciate that if you take the matter to court there is a risk of higher fines and court costs.
