Not In Proper Control – Texting

Question:

Not in proper control of vehicle as sending text message

Was seen sending a text message while driving very slowly in stop start rush hour traffic. I thought I was in full control of the vehicle however the police officer disagreed is this worth fighting or is it unlikely to be found in my favour?

If you admit texting the prosecution will simply amend the charge at court to using a mobile whilst driving and convict you of that if there is any doubt re the not in proper control charge. The court wont have any sympathy on this one I’m afraid.
