s.172 I Wasn’t Driving At The Time And It Wasn’t My Car

Question:

The date which has been sent to me on the letter I was away can prove if I want, & the vehicle wasn’t in use either, so it wasn’t my car!

Dominic Says:

I assume that you have been asked to name the driver of the vehicle when an alleged offence took place and you are unable to do so because you were not driving at that time and you do not believe that the vehicle was in use.

You should explain this to the police and ask to see the photos to make sure that your number plate hasn’t been cloned. Make sure you ask everyone that has access to your car within the household whether or not it could have been them.

Is the location of the alleged offence close to you home address and a road that you would travel down? Is the time of day odd?

Tell me more and I will be able to help further.

You have to be careful because if it was your car and you fail to name the driver you are at risk of 6 points and a hefty fine. Have you got any points already? If so, how many?
