I was stopped in my girlfriends car for speeding and it is going to court. She is the registered keeper but the summons and notice of intention to prosecute has been send to me.
Do the police and courts have a duty to inform the registered keeper of court cases and would this proof a loophole? I was only doing 50 in a 40 late one night. I thought a telling off might have been fairer!
No. If you were stopped then there is no obligation to tell the registered keeper. They have to serve a notice of intended prosecution on the registered keeper if they don’t know who was driving but if they do know then they simply warn you.
Have you got any points already? They don’t tend to give warnings for speeding offences.
