Speeding – Trial Date?

Question:

I’ve progressed to the stage where I got the Magistrates to issue me with ‘the video’ free but it is now 5 days late from the 20 day ruling. I applied for a pre trial review after I got this video as Dr M Clark and T Farrow are going to look at it as they know this is crucial in this case.

The CPS state that it is their prerogative whether the evidence is admissible????? I have asked for further evidence re can the operator give evidence in writing that he is able to assess the speed within 10% accuracy at 161 metres within 4 seconds due to the car appearing in view from a bend within 4 seconds.

The terminology they state is Trial Hearing 9th April so am I correct in interpreting this as a pre trial review and not the TRIAL???

Its sounds like a trial date to me.

Both the court and the CPS are notoriously obstructive when it comes to giving you enough time to prepare. The CPS will serve disclosure late. It’s up to them as to whether or not they intend to rely on it as evidence at court. You can adduce the evidence if it undermines their case against you.

You need to call the court and ask if it is a trial date – if it is you need to ask for an adjournment and explain the late service of the video.
