Interesting question about whether you need insurance for a pedal cycle that has a motor attached.. Does it need insurance? Do the Road Traffic Acts apply?

The police stopped me and found out my liecence had been revoked for fasiling to send it in for points to be added.

They then suggested that my insurance for the car was invalidated due to the problem with my licence. they have charged me to court with driving with no licence and driving without insurance!

i got caught about 3 mouths ago when i had only a privisional license i did have my car insured with quinn for provisional drivers but because i didnt have a quilified driver in the car with me at the time and no L plates on show the police are trying to stich me up i only recently past my test and got a summons to court for the offence.what do you reckon will happen over this now

Alleged Offence: Caught doing 37MPH at 30MPH road and No Insurance
Your road traffic offence question: The NIP has only indicated the offence of over speeding at the moment and has required me to provide the name of the driver. Though there was additional clause that if subsequent check reveal the car was at the time of the offence driven without certificate of insurance proceedings may be commenced in respect of those additional offences.
What can I do. I am thinking of completing and send the log book back to DVLA and putting a date before the incidence as the sold date. My licence is just 8 months old and I do not wany to lose it.

I have been charged with the above three offences. My mitigating circumstances are that firstly I took my brother-in=law's vehice in an emergency as my son was having a massive nosebleed and I was going to the chemist. My own car was gone for repairs. Secondly, I believed that I was insured as the online policy clearly stated I was(able to provide copy) but later on (after I was charged) I found out I wasn't and the insurance company had made an error. I was the additional driver and hence I did not have the Certificate of Insurance but relied on the details given online about cover. As I was going in a state of panic I went on my own, my wife who usually accompanies me could not go as she was taking care of our son. I also forgot to put the headlights on the way back.
My hearing is on x 2011, this is my very first offence, I have been driving for over a year and have always abided the law. I am very nervous and fear that my provisional licence may get revoked. I have my driving test 1 week after the hearing.
Your advice will be greatly appreciated.

I have received a letter from the DVLA requiring me to return my driving licence to them today.

Apparently there was a hearing on the x 2008 at x Court. I did not know of this case as I did not receive a summons. I want to know what I was charged with and why I was not informed there was a procecution ongoing so that I could at least defend myself.

The only Incident I can think of happened in x 2010 when I was living in x.

Two Police officers came to My flat (without any Warrant) on a sunday. I was preparing to go to church with my family. They alleged my vehicle did not have an insurance policy. I assured them I had a policy and in fact, showed them the insurance certificate which was valid at the time of the incident.

They did not stop me on any road nor charge me with any offence but the officer drove off with my vehicle from my car park to a private garage where I had to pay £150.00 to recover my vehicle.

I was not made aware of any prosecution at the police station when i produced my insurance certificate and recovered my vehicle.
All I need is to be informed of the legality of the police officers' right to impound my vehicle from a private car park and then prosecuting me without my knowledge which I believe is unfair to say the least.
I have my Insurance policy and a copy of the seizure notice, on which the offence is not clarified.

Hi,because soon I'm going to buy my first car my question doesn't regard commited offence but I was wondering how canI bring a new car bought from private seller from the place I buy it to the place I live ( distance of 50 miles ish)without having insurance for this car in my name-is it a driving offence if yes how can I avoid this(I don't have anybody with the right insurance who could drive it for me).Therefore is situation different when you buy from trade seller.Kind Regards

I was caught driving with no insurance and only a provisional licence. I was on my way to pick up my Mum from work at the time I was stopped. We both work at the same place but on different shifts, we've requested time and time again to be put on the same shift but are just told it's not possible. I was working from 5:45am until 1:45pm, my Mum would then come in at 1:45pm (when she started) leaving the car for me to drive home at 1:45. I would then come in at 9:15pm to pick her up. It was at 9:30 when I was caught. I was turning into the place of work when I noticed the police van waiting a few yards along, parked up with no lights on, when I turned off they proceeded to follow. I was out of the car and only upon my return to the car passenger seat was I stopped and questioned. I figured the game was up because cctv would have proven my offence and admitted apologetically. There was no other way for me and my Mum to both get to work as we live in a remote location with no public transport. The only alternative would have been a taxi, but financially this is out of the question as it would be £400 - £500 per month. We're both on minimum wage and could not afford this. I have subsequently had to again request to be put on the same shift, if they decline then I will have to leave my job and not be able to get another job due to not being able to get to work. Would special circumstances stand in my defence?

Your road traffic offence question: Good afternoon, Excuse the email rather than phonecall but I am at work and unable to talk privately at the moment.
on friday evening I was driving to x and was stopped by x police en route for not having the correct insurance on the vehicle I was driving. THe history is that I have a different car for which i have fully comp insurance and am the registered owner. I was driving a car I am in the process of purchasing.This belongs to the mother of a friend but due to a loss of the V5 in the post between her and myself ( already reported and the she is awaiting another) it is not yet registered to me. I believed that I could drive this on my existing insurance, but the police who stopped me said that regardless of the issue of the V5 , the car was mine and as such I was uninsured.
They issued a fixed penalty notice of £200 and said it would be an endorsement of 6 points on my license. They did not seize the car and took me to somewhere where I could then be collected by a family member who was able to drive my car. They said they didnt believe I had done this on purpose as it was clear I did have a policy on the other vehicle, hence not seizing the car and allowing me to find an alternative solution. Also I was in x and a long way from both home in x and x, my destination.
I left the car at my sisters and rang my insurance company on Saturday morning to ensure it was insured. I then drove it home on sunday.
My other problem is that on looking at my driving licence in preparation to take it to the police station within the 7 days I have noticed it is expired. I have a photo licence and did not realise this was the case. It expired in January last year.
so now I have a compound problem of having no insurance and potentially a non valid licence.
I would like some advice on what my options are. I am obviously guilty of both things and not being aware, or not doing it deliberately are no defence. Particularly on the potential consequences of the two things together. I can see that not having a valid licence could mean another 6 points which would then mean a loss of my license. Is action on a non valid licence likely to be a certainty? What will happen when I produce it at the police station- which i need to do asap.
Many thanks for any advice you can give me at this stage. Your website was by far the most approachable of all that I have looked at. I have no doubt I have got myself into a predicament, unwittingly or otherwise, and I just need to know what my best path through this is.

Ive just bought an old x and drove it home to phone up my insurance
company. Unfortunately i went passed one of those police vans with a camera sticking out of it and obviously im now worried.

My car before was written off after being hit by someone else who admitted it was his fault. I thought my insurance would carry on enabling me to drive this new one, now im not so sure after speaking with them earlier today. I have the log book which i prersume means the car is still in the sellers name until DVLA get the paperwork and put it in mine.?

I wonder whether i can say i was test driving it as i wasnt sure whether i
wanted the car or not. I do and am insured from earlier today.

Im just hoping that the police will see that this all happened on the same
day and i had no intention of driving without insurance as i never have.
The car is MOTd and taxed.

Your help, as always, would be much appreciated.

i drive a recovery truck i stop by the police there excuse for stopping me was the car on the back they had to check it was not stolen. after they done the check .they told me i was not insurance to carry scrap metal.i was taken it to a scrap yard . when the copper phone to check the insurance he told them i was carrying scrap metal .well it was not scrap metal it was a hole car . of cause the insurer said i was not insurer because iam only insurance to carry cars and salvage .i tried to explain to the police that it is only turn into scrap when the scrap get hold of it .they seized my truck . when i went to the police to produce my insurance i done with the insurance the police said i didnt have also they haveput the wrong reg on the ticket my insurers said i have cover for that vehicle where do i stand

I had to re new my car insurance about 3 months ago and when I received the
paperwork through I looked through it to find out if I could drive other
cars and be covered third party I couldn't find anything other than some
small print saying no driver named on the policy is covered to drive other
vehicles, I assumed that meant named drivers as I have a name driver on my
policy as I was unsure I rung my insurance company and just said I have a
quick question am I insured to drive other cars gave them my date of birth
(im 21 by the way) and the man I spoke to said yes that should be fine I
double checked and said are you sure he replied yes. So from then on I
assumed I would be covered in the event I drove another car. Then early
Sunday morning I drove my friends car about a mile as he was too tired to
drive and I stopped in a car park. Then the Police came into the car park
and asked if I had drove the car I said yes and they found out im not
actually insured on other vehicles, They was going to give me a producer but
then found out I was who I said I was and was insured on my own vehicle and
said there's no need to give me a producer but there was a police woman
there and she said I would get 6 points for this. But I didn't get any form
of paper work to say I had been stopped so im just wondering if they have to
give me some sort of paper work for me to get prosecuted for this or whether
they have given me the benefit of the doubt as I was unaware I was not
covered? The police officer didn't make it clear what was actually going to
happen, they took all my details address contact number and where I had been
that night etc. I have also been in contact with my insurance company and
said unless I can tell them the exact time and date I called them they
cannot prove I was wrongly advised and as I make hundred of phone calls a
day at work it will be nearly impossible to remember when I made the call.
Sorry for such a detailed question I was told to give as much details as
possible to stop any confusion.

i have a comprehensive insurance policy which gives me 3rd party cover to drive other vehicles with the owner's permission. my son has a vehicle with no insurance and i have been advised by my insurance company that i am covered to drive his vehicle for ocassional use. i have been advised by someone who works in a car pound that this is not the case and the vehicle could be seized if there is not a policy in effect wrt the vehicle specifically. who is correct?

teaching under age driver on private property
Your road traffic offence question: Very stupidly, I allowed my 15 year old to get behing the wheel on a large private area that was an old airfield and is currently used for paintballing. He had about 5 minutes behind the wheel and never got past 1st gear. We were just going when a car pulled up and told us that the area was under CCTV and that I would be sent to court and will lose my licence. I am devastated. Can you tell me what I need to do, Thank you. This happened today, I await with dread a court summons.

More detail about alleged offence: I have just bought a new car, the previous driver still had it insured and I drove it home on my insurance which covered me to drive someone elses car with their permission, Im staying at x, which I believe is a private road. just before I got to my parking space on a blind corner I heard a van screaming, I stopped my car and the van came around the corner far to fast and crashed straight into me, police were on scene. once we had finished I rung my insurance company to inform them of the accident, They in turn informed me the policy was cancelled two days ago for non payment. Im getting divorced from my wife and it turns out she had cancelled the direct debit but told me the insurance was up to date and she had chucked the letters so I wouldnt know. So it boils down to i have had an accident on a private road with no insurance although I was lead to believe it was still in place. I have not been arrested or cautioned for the offence yet!!
Do I have any leg to stand on? what can I do? I dont even know how this will play out?

Your road traffic offence question: I was stopped by the police last week whilst driving my car and they told me that I was not insured. I argued that I was as I renewed my car insurance in x of this year. However, when I contacted my insurance company they at first said that my insurance had not been renewed. I pointed out to them that I had at first said that I did not wish to renew as I had received a better quote elsewhere and I advised them that I had cancelled my direct debit. My insurance company then offered a better quote and I accepted this. The insurance company later came back to me saying they had listened to the recording of my conversation and they agreed that I had accepted the renewal but they than told me that they had not received any payments as I had not given them my direct debit details. I was advised by the lady I spoke to of the installments that I would pay and she said that these payments would be taken on a monthly basis by direct debit. I had already advised the company that I had cancelled the original direct debit instruction and she at no time did she request any further bank details from me. I did not question this as I assumed that they would use my existing details. When I pointed this out to the lady on the phone she admitted that they were at fault for not checking/requesting my details not mine.
She went on to say that they had written to me on two separate occasions regarding lack of payment but I did not receive any such correspondence from them - if I had I would certainly have taken steps to resolve the issue. I later spoke to a friend who suggested I telephone the insurance company and request copies of all correspondence they said they had sent to me. The lady I spoke to on the phone said that she would need to speak to someone and come back to me and that they would send me copies of the letters but could not guarantee that they would not have the current date (i.e. the date I was speaking to her) on. She said she would see if they would back date the insurance and call me back.
However, when they called me back they said there was nothing they could do as my case had now been passed to collections.
Two days later I received copies of letters in the post which were dated at varying intervals and were sent “yours sincerely” by the same lady I had been speaking to throughout. This leads me to believe that these letters were not sent out to me as stated in the first place and I think that the lady I have spoken to one the phone has simply printed off standard letters and back-dated them. I appreciate I cannot prove that this is the case but it seems to me that I received my insurance renewal documents and these copy letters through the post without any problems so why would the originals just not show up?
Needless to say I will be receiving a Court date shortly and would be grateful for any advice you could give me.

Alleged Offence: Use of a motor vehicle without third party insurance
Your road traffic offence question: Circumstances
1. Pulled over as car was flagged as uninsured.
2. I genuinely believed that I was covered by the insurance policy as I had seen certificate and had been reassured by policy holder.
3. Policy Holder believed that the vehicle was insured as he had no communication stating otherwise.
4. x Insurance admitted there was a breakdown in communication to say that the policy had been cancelled due to non payment.
5. x had unwittingly mislead x into thinking she was insured to drive the vehicle at that time.
6. Upon realisation that the vehicle was uninsured x stayed at the Service Station until a new insurance policy had been setup so that she could continue her journey.
Mitigating Circumstances
Whilst I admit that I am guilty of the offence committed, I was mislead to believe I was insured at the time of the offence. There was a genuine misapprehension that I was insured at the time of driving. As I was not the policy holder I had done everything in my power to ensure that I was covered. I had seen a copy of the certificate of motor insurance which stated that I as a named driver was insured to drive the aforementioned vehicle until x2010. A copy of which I have enclosed. The policy holder assured me that i was insured to use the vehicle at the time the offence was committed. x himself had no reason to believe that the policy had been cancelled as he had not received any communication to say otherwise.
Upon being stopped by the police, x phoned x to confirm her belief that she was covered to drive. x then phoned x to ask why there was a problem. It was only then that he became aware that the policy had been cancelled due to non-payment. Upon news of this x asked why he had not been informed of this and was told there had been a letter sent out but never received. The lady at the end of the phone admitted that there had been a “breakdown in communication”. Please see the enclosed complaint to x regarding this matter.
I waited at the service station until x had put in a place a new insurance policy. When i had seen confirmation of this, I then, and only then continued on my journey.
As a x graduate I take the law very seriously and would never knowingly break it. I spent a lot of time and money learning to drive whilst at university 18 months ago and would not knowingly drive uninsured risking prosecution and or getting involved in an accident while uninsured.
The policy holder, would under oath be prepared to state that he did in fact mislead me that I was insured, albeit unintentionally.
This had affected my confidence in driving and my partner x. It has been playing on my mind ever since the offence was committed and I am very worried that I am going to have my licence revoked for something that was in fact my partners fault.
How would you reccomend aproaching this case? Plead guilty and get a solicitor to write a letter of mitigation or plead guilty and write my own letter of mittigation?

Alleged Offence: No Insurance
Your road traffic offence question: I was pulled over for not being insured driving a friends car. My Insurance had defaulted for non payment, but wasn't aware. I passed my test x 2008 and was pulled on x 2010. I was given a FPN of £200 and 6 points.
I am unsure of how the limit from 6 points to 12 works? Should I have applied to get this extended from new driver ruling or will my points limit have already been increased?
I am worried I will have my license revoked and cannot find the information online regarding this.

Message: ive been issued with a fixed penalty notice (endorsable)£200 from the met., because the national computer data base said I was uninsured. my husband volunteered to immediatly produce the relivant insurance documents at our local police station, police officer would not talk to him & issued the above notice. I now have personally produced the documents & have had my driving license taken from me, (by request of the issuing officer). I apparently have to pay £200 & will get 6 points on my license.....BUT IVE DONE NOTHING WRONG. please can you advise
Before I realised what a horrible mess this was I had made a complaint to the poilce station about the officers behavior towards me during this incident, I only stopped him to ask for directions

I had moved homes and for some reason my insurance company did not get my letter of change of address. Several months later my insurance ran out, the renewal notices had been sent to my old address.I was stopped by Police who informed me I had no insurace.I feel that because I dd not have the intention to commit an offense, I have a defence.
According to thwe Road Traffic act 1988
143)A person charged with using a motor vehicle in contravention of this section shall not be convicted if he proves—.
(c)that he neither knew nor had reason to believe that there was not in force in relation to the vehicle such a policy of insurance or security as is mentioned in subsection (1) above.

Subject: Driving without insurance
Message: I had sold my old vehicle on x for which I had comprehensive insurance policy till x. I had bought a new vehicle on x and renewed my insurance from x. Unfortunately I failed to inform the insurance team about the change in the car and met with an accident on x(I hit a stationary Ford x model car from behind). I only had car insurance for my old vehicle at this time. My insurance for the new car was only due to start from x. The police were there at the scene of accident. They breath analysed me and found no alochol. They asked me to exchange my "details" with other car driver which I did. When I called my insurance company, they informed me that my new car was not insured. I informed the opposite car driver about it. I am still awaiting summons from the opposite driver as well as the police. I am not sure where to go from now. May I know if I have to pay the whole expenses for the damage to the car. May I know what are the implications please.

Alleged Offence: Driving without Insurance And turned in no entry
Your road traffic offence question: I was given 6 points because I missed a direct debit to my Insurance company and my policy was cancel without my knowledge. Thee months after I turned into a no entry without realising it. This offense should be a minor but I was given 3 points for it.
I am a PCV licence holder and with 9 points on my licence I am unable to go back to drive buses.
I am currently unemployed, could you please help me.

Your road traffic offence question: Hi i was sitting in my sisters car and my mum was driving she had an appointment at the hospital we were round the corner from the hospital literally 5mins away and she didnt feel good and couldnt drive anymore so i drove the car from there and as soon as i turned into the hospital the police officer stopped me and checked that i didnt no i fought that i had insurance but i am a named driver on another car and a van the police officer gave me a producer which i get 6 points and a £200 fine i have been passed for 4years nearly and i am 22 years old how long will it take to clear the points and is there another way round this thank you.

I am an additional driver on my girlfriend's (x) 3rd party insurance. She has kept upto date with insurance payments for 10years. I am a new driver and she kindly went with a cheaper car insurance agency and put me on as additional driver. It is a family car and i use it to provide youth services which i will nonlonger be able to do without my car. I was pulled over on x by the police saying they cannot find insurance on the car. We have made all payments throughout the year, however the company changed their policy and no longer insure those under 30 years of age. we did not receive a letter explaining this, and x with 10 years of driving assumed like all her other previous insurance companies they would renew automatically. While with the police i called x and and she found that the insurance ended 2 weeks before i was stopped. I have a full driving licence MOT and Tax and driving under the impression i was fully insured. we are both professional young adults working on a new family. We have never been in trouble with the police and obviously this was an honest mistake. Which could have been avoided had the insurance company made a courteousy call to find out if we had received their letter. I am starting a new Yoga/Martial rts business and x is a Teacher through an agency so money is not regular and this will cost us dearly and i will loss my licence for being an honest citizen! Many people drive around intentionaly without any legal documents whatsoever and they are not penalised in this way, i think itr is outrageous. Is their some way you can help or give some helpful advice.

Alleged Offence: car accident
Your road traffic offence question: Had a car accident last week. I was coming out of a side road into a main road. There was car in front of which was going forward so I indecated to go left. Suddenly he reversed to go into a parking bay on the right hand side, not looking at his side mirror but concerntrating only on his right not his left where I was. He reversed into me and had the full impact on my front. He has scratches on his left , back side.
I ahve contacted him as we exchanged mnumber and addresses. I recieved a letter from his car insurance within a week. Asking that I send in my licence etc. The thing is I am a provisional driver. I have a car insurance but I said that I am a full driver. What shall I do. I have offered too pay stating that I dont want my car premium to go up. He has declined at he reckon that it was a company car and that they are sorting it out. What do I do?

I am a named driver on my flatmate's insurance for his car. He lent me the car to drive to work, both of us under the impression that I was covered. However, his insurance had lapsed 2 months earlier (his dad had offered to pay it and then forgotten). I got pulled by the police driving the car and given 6 points and a £200 fine. My question is this: is it my responsibility as the driver at the time, or the car and policy owner to ensure that the policy is valid? Do I have any defence regarding the points (previously I had a clean license)?

In august of 2008 i was sentanced for failing to produce a specimen of breath.
(At the time my licence showed spent endorsments convicted on 01/10/04 for failing to provide driver details (ms90)and speeding(sp30)totaling 6 points.)The court took in to acount my mitigating circumstances and did not ban me but endorsed my licence with 6 points, to my relief.However I had on the day handed my licence to my solicitor expecting the ban.As this did not occur I had assumed that my licence would be returned to me with
these 6 points & the spent ones removed. This has not happened. I have spoken to my solicitor who thinks he gave it to the court. I have spoken to the dvla & here is the real problem!! They refuse to give me any info via internet or over the phone but did go as far as to tell me that they have no information on me from 2005? The lady went as far to help as she could by advising me that this was a payment issue with regard to owed fees. (I assume this is the 2004 offences.)However I did pay these fees as they sent me my licence back then as it should have been.She suggested that my licence may have been revoked in 2005! And that I should apply for a lost licence along with the fee which I intend to do.
However I have since split from my partner & am living at a different address. Then just recently she called me to inform me that I had had a letter from the court convicting me of driving with no insurance in summer 2009? She threw the letter away!!! This was NOT me!!! What do I do???

I only got it on wednesday when 2 policemen came to my house to serve me the summons since I changed my address. My court date is this tuesday x. and I really have no time left since I have to send this form straight away.
I didn't know about the insurance. I thought cars had to be insured so i asked my friend and it was insured. i didn't check or ask anything else since he didn't tell me additional information that I need to know. He has been charged and fine already so his case is closed. And the license, I don't have a UK license but I do have a home license from my country in Asia so I thought it would be okay to just drive for a bit. It was only for about 15minutes or so. I knew how to drive so i wasn't endangering anyone. I was just too eager and determined to learn the routes and because in UK, you drive on the left where as i've driven on the right side of the road only. I didn't check that I couldn't use my home license. I didn't know it was going to be this serious or I would have never done it. I don't even know law or politics about my own country so in another country, i'd be useless. It was just that one off occasion where I just needed to know what it was like to drive on the left side of the road and just to learn abit about the routes and roads. I really don't want to be guilty etc for something I didn't know or fully understood although it may seem as an excuse or ignoring the law but I really didn't mean or expect any of this. Do you think I could have someone to represent me in court and defend me to be not guilty. Would I have any chance at all? Please reply to me asap. Thank you very much.

Your road traffic offence question: My partner has to appear in court on x for driving with no insurance. He wants to plead ‘NOT GUILTY’, as far as he was concerned, he still had insurance. The form has to be sent back asap but i'm wondering if he should have a solicitor. I am his only witness other than our 4year old daughter. He is not good at reading and writing and I deal with his paperwork but at no time did I personally see anything come from his insurers to say that it had been cancelled. He is on Income support as well. In the police report sent to the court, the officer hasn't mentioned that he was driving with me or our daughter as if he was on his own. Help! What do I do?

Whose car were you driving at the time? this is an important question. If the insurance company have admitted that it was their mistake and that they misled you into thinking that you were covered then you have a strong special reasons argument to avoid the penalty points. You get 6-8 penalty points for no insurance.
It maybe possible to persuade the police to withdraw the allegation if you have managed to get the insurance company to admit their mistake in writing?
Have you got any penalty points already? If so how many? How long have you been driving.

Your road traffic offence question: Asking on behalf of a friend whose car was impounded for allegedly driving without insurance. She was unaware her insurance company had cancelled her policy (they had ceased using a 3rd party supplier) as they did not request her certificate back and have continued to take direct debit payments. Does she have grounds to challenge IN10 on the grounds of 'unknowingly driving without insurance', and if so how should she do this. She has presented all required documents and recovered her car, set up new insurance, but has had to pay out c £500, now concerned about possible points and fine. Please respond by email.

Once he passed his test there was a balance to pay. His dad was paying for his insurance as we are separated and my son works for his family business so used the car to get back and forth to his workplace. His dad forgot to pay the balance and the insurance was stopped on leaving my son uninsured. He thought his dad had paid it now he has had his licence taken away and 6 points added. Message: Hi. My car was was in the garage for repair and the driver from the garage was stopped by police and questioned about my car as they could not find any insurance info. The garage notified me and I immediately checked my insurance docs and I was not covered. I have not been driving the car for some time as it has been undriveable but I understand that this is still an offence. I know everyone says the same thing but I genuinely did not realise my insurance had expired as in previous years they have automatically rolled the insurance on if not contacted but I understand that they are no longer allowed to do this. Yesterday my wife aged 64, was stopped on her 49cc moped by the Police. The officer said her wheel looked wobbly. Anyway, during the discussion, he checked the Insurance and found that my wife was not named on my Insurance policy for the moped. He didn't pursue the matter about the wheel, but did issue her with a note to present a Cert of Insurance within the next 7 days.

She holds a Provisonal Driving Licence, but has forgotten to renew her CBT Test Ceretificate in the last 3 years. (She used to be insured, but when I tried to get her on my policy last year, they said that she now required the CBT before they could put her on.)

I am insured to drive it, as I have a full car licence, but the bike is registered in her name. We have made an appointment for her to take the CBT test on Thursday and we can then get a new Certificate of Insurance before Monday, when she needs to go to the police station to present it.

My question is, will that be acceptable to them, or will they say that she was not insured at the time and thus is in breach of the law? My fear is that I could be prosecuted for knowingly letting her ride the moped. If I am banned from driving, I will lose my livelihood, or would we just receive points and a fine?

They checked my insurance and because it was my friends car they said i wasn't insured because on my policy it says i cant drive other cars, however my freind said he had car dealers insurance therfore i was covered. It was about 12pm. Then there was confusion on how long he had had the car for because apparently its only valid for 3 weeks. I have now been summoned to court but hadnt received any previous letters. I no longer speak to this freind and never saw his insurance document so i dont know where i stand in the laws eyes? I have spoke to a colleague of yours who has recommended I email you for some advice.
Last month the police pulled over for having no car insurance. I had no idea that privilege had cancelled my insurance.
I have now been told that Privilege car insurance stopped my insurance due to a missing monthly payment.
I have been driving for 10 years and I drive around 25k miles per year and have no points on my license.
I have been told by direct line that the offence code on the fixed penalty notice is incorrect, can this be argued in court.

Your road traffic offence question: Yesterday morning landed in England from a 3 weeks holiday, whist i was away my car insurance had ran out.
Because i had been away and not received my renewal letter i had no idea my insurance had ran out.
I incidentally was pulled over by the police that night, i believed i had insurance but clearly i didn’t..
This resulted in my car being taken away and me having to produce my documents..
I renewed my insurance first thing the next morning and got my car back at a cost of £150..
Now i don’t know weather to risk it at court and contest my punishment as i see myself as a good honest driver and it was a genuine mistake one who has 5 years no climes and always had insurance also proof of this or take the full punishment?

I am writing in to request for a court hearing regarding the fixed penalty notice that was produced at x. This penalty notice was produced due to me not having any insurance at the time of the notice.

I was insured by x Insurance, my insurance started onx . I was paying my car insurance by monthly instalments via direct debit. I was away on holiday from the x till x. On the day I went on holiday I took my car to a friends house which is close to x airport. When I returned from holiday I went and picked my car up and was travelling back home and did not know my insurance was cancelled. When I got stopped by the Police, the officer told me that I had no insurance on the vehicle and gave me a fixed penalty.

When I got home I checked the letters that I received when I was away to find that my car insurance got cancelled. It was cancelled on the x, 9 days before I got back, due to not having sufficient funds in my account. I understand that this is my responsibility, and I should have had sufficient funds in my account, but I run a business plus I deal with the household bills and I believed that I had covered all the impending bills in all my accounts before I went on holiday.

I have sent in the copy of the first notice letter from my insurance company requesting payment for the unpaid instalment. It was produced on the x, two days after I went abroad. There was no one at home to reply back to this letter or notify me. The notification of policy cancellation letter was produced on the x, when I was still away. I have sent in photocopies of my insurance certificate, passport and e-ticket to prove I was away during these dates and also to show my insurance arrangement with Co-operative Insurance.

I have held my licence for six years now. My licence is still clean as it was first given and I consider myself to be a responsible driver. I have never driven my cars without insurance or never had an accident. I know how strict the law is about uninsured drivers. I use my car to get to work six days a week doing a round trip of 14 miles a day therefore my car and licence is very important to my livelihood. I plead of you to not deduct points of my licence just because of this genuine mistake which I understand and accept. I am prepared to pay a fixed money penalty charge if my plea is accepted as my licence/car is essential for me to run my business and to earn a living.

Your road traffic offence question: I own two vehicles, one is ax, and one is a y. I had to renew the insurance on both vehicles recently. When renewing the insurance on the x, I provided the vehicle details for the x, but accidentally entered the registration number of the y, so technically I insured a car that didn't exist without realising. I was pulled over for having no insurance, and when I looked at my insurance certificate I realised what I had done. I have explained the situation to the police and that it was an honest mistake, but they advised I would more than likely be prosecuted (although I have yet to receive a court summons). I didn't intentionally drive without insurance, it was an honest mistake. I obviously should've checked the documents more carefully, and I accept the blame for that, but I also feel the insurance company shouldn't have taken my money to insure a non-existent car, and that they too had a duty to check. I also wouldn't intentionally take out a policy on a car that doesn't exist, so the police can see there is no intent to break the law on my part. I also wasn't trying to scam the insurance company because I had already insured my Golf so there would be no need for me to insure it again. I require my car for work as I am a x worker and drive people around on a daily basis, so I also wouldn't intentionally put them at risk by driving without insurance and I also wouldn't risk losing my job by doing so. Can you advise what my position would be? I've been driving for over 2 years and have no points on my license, but I want to avoid any penalties if at all possible.

the law relating to insuring a motor vehicle not driven and kept off the public highway
Message: I have purchased a motor vehicle to park in front of my garage on non-registered, unadopted land (ie off the public highway). The vehicle is there purely to stop people obstructing my garage. It is not to be driven at all, including on the highway. Insuring the vehicle for 3rd party/fire/theft would cost 3x the value of the car. Therefore do I need to take out insurance in this situation and where would I stand if someone else bumped into my car - would I be liable if I had no insurance on the vehicle even though it would be off road and stationary? I rung your office on friday and they advised me you may be able to help advise me on a situation I have found myself in. I'm really worried and concerned about the situation I find myself in and would really appreciate it if you could get back to me as promptly as you could.
On the x I was involved in an accident, I take full blame for the accident as I went into the back of another vehicle. No one was hurt however the other persons car was damaged. On returning home I dug out my insurance document and found out it had expired on the x. I had received a letter from them to serve as a reminder but my fiancee had put it in a drawer while tidying up without realising what it was. I was paying in a DDEB so presumed it would just automatically renew. I know this is my mistake, however it is a genuine one. It is also worth mentioning that at the time I was driving my fiancees car, however my insurance policy covered me to drive other vehicles 3rd party. Obviously I can prove that and when my insurance ran out.
I offered to pay for the other persons car to be fixed but he insisted he wanted to go through his insurance. If I contacted them and offered to pay them for the full repair would they accept that? And would they then contact the police anyway?
My job does involve some driving as I occasionly am asked to attend meetings across the country. I'm also in the process of changing roles, and the new role would mean driving everyday and would be integral to the role. Without being able to drive I would lose my job. This is one of the reasons I'm so concerned.
I also have what I view to be a essential reasons I continue to be able to drive for my personal life. I can elaborate on these if you need me too. I'm just really worried I could be facing a ban. What sort of sentence do you think the courts may give me? Would I be looking at a ban?
Apart from contacting the other driver to offer a cash settlement I have done nothing further with this. His insurance company contacted me a few days after the accident, asking me to confirm the car registration however I did not have the details with me at the time. What should I do as a next step? Is there anything I can do at the moment that will help my situation?
I would really appreciate your help in answering my many questions and any advice you can give that will help me deal with this situation. I'm currently in a state of panic and I'm struggling to eat and sleep as the loss of my license will have such a detrimental affect on my life.

Good afternoon Emma,

i was driving my sisters car to have it repaired when i was caught in a mobile laser speed trap, although on approach to
the police stop area there is a SID (sign that flashes your speed) which flashed 25mph but they told me i was driving at 42mph.
I gave them (police) all my details and i received the NIP shortly afterwards, however my sister was not notified, although i did
tell her immediately.

I believe the insurance case is cut and dried, i have fully comp and so does my sister but she has only herself as designated driver and my policy, unlike previous insurance (i have 10 years no claim bonus), does not cover me to drive other vehicles.

i have conflicting information regarding who needs to be notified. I do also have good case to argue the speed i was doing, as it was raining and the road they clocked me on is downhill on an S bend.

I presently have three kid age 5, 4 nad 2 who will be resuming at different schools and different time in few weeks time and I was hoping the she gets her full licence before then since my present job dictates that I will not be availble to take the kids to school as I used to. My question is to know how serious is this offence and most importantly how do she avoide a serious fine and suspension of her provisional drivers licence to enable he undertake the neccessary test for full driver licence.

My granddaughter was stopped at a random check driving a car on temporary loan registered to me, insured by me on a comprehensive policy and with her mother as named driver. We believed that reduced cover would apply to my granddaughter driving on rare occasions as it would have in the past and did not realise that the insurance industry’s terms have changed but she is charged with not being insured. I immediately corrected the situation by adding her name to my policy and paying the adjusted premium to provide cover from the day following the offence. The mistake was a genuine one for which I have a responsibility, as my daughter and I were acting upon historical experience rather than properly investigating the terms of my policy, the details of which my granddaughter was unaware. I have written a statement to this effect and apologising to the court.
Question:
In order for the statement to be taken into consideration, does she plead guilty or not guilty?

I am a student immigrant in the UK and I drove for the very first time a car I did not know but later understood was not insured. I bought the car from the seller where I was told that the MOT, Road Tax and Insurance were intact.
I collected the MOT and Road Tax documents but I was told by the seller that I am insured under him to drive it to my place of aboard and then get it insured under my name. I had believed the seller, to whom I explained my vulnerability about the traffic law since i just got to the UK newly.
I then drove the car with this intent in my mind that I was insured. I never wanted to drive without insurance, and if I had known that what the seller told me was wrong I would not have driven the car, but due to my ignorance and illusion i confidently took the car. I was convicted two months ago, but I have always thought that I do not deserve this conviction since the owner knowingfully well that I needed to be insured made me to drive the car to fulfil the deceitfulness of his aim to sell or get rid of the car at all cost, thus as a result putting me into problem unknowingly. I have just thought this is injustice. Do U pls have any advice for me if I can prove beyound reasonable doubts that I drove the car without a wilful act.

I was misled by my insurance company as to the nature of the cover in place and these lead me to believe that I was insured at the time of driving the car. My car insurance company cancelled the policy failed to notify me of that in advance of the offence and provide documentary evidence in order to support my argument the car was only temporary cover, the insurance company assumed that I knew this, I can confirm that I have been with the same car insurance for over two years. The supervisor driver confirmed to me that she had a full driving licence for over three years. She passed her driving test x 2007. The L plates were placed on the car when I started driving and must have blown because it was a windy day.

I am responsible for paying my partner's car insurance. He drove his car believing he was insured, however it had been cancelled due to insufficient funds in my bank account. He was stopped and has been convicted with an IN10 on his licence.
Can he get this removed? he has been offered a job if he can get this appealed, otherwise they won't employ him.

Your road traffic offence question: My partner was involved in a car accident and the car is a write off. However when checking through my policy my endorsment isnt on it and am now afraid my insurance wiil be void. Can I explain to my insurance company whilst this claim has now begun.

I received a fixed penalty notice letter through the post for a speeding offence of 36 mph in a 30 mph zone. The letter states a fine of sixty pounds and three points on my licence. Unfortunately, the driver was not me but my x friend who was driving back part of the way home as I was tired and I immediately stopped driving when I noticed I was low in blood sugar due to my diabetes. Although he was very careful about speed cameras, obviously on the way he must have sped over 30mph via a mobile camera. Unfortunately, when I read the fixed penalty notice, it stated that when I state my friend as the named driver, they will ask for insurance details of which he was not insured. He however does have a full driving licence.
The question I have is if I state that my friend was the named driver, I will not be able to prove insurance details and will therefore face a court appearance, a 5000 pound fine and 6-8 points on my licence.
In 25 years of driving, I have always had a clean record but in x thsi year, I was caught at 39 mph on a road I had used everyday to get to work at 40 mph for 10 years when it all of a sudden changed to 30 mph. So at the moment i have 3 points on my licence. I am now worried that with this offence I will lose my licence.
If I state I was the driver, then I'll get 3 points and 60 pounds but are they meticulous at checking photo ID to the photo evidence? I can always state that I couldn't remember who was driving at that time but then I risk a fine of 1000 pounds. This is my dilemma.
I am really fretting about this as I am one careful driver and feel that i do not deserve losing my licence when others are so manic on the street. My problem was that I did not include him on my insurance before the journey began but as I stated, my friend took over when I had low blood sugar to get me quickly to a place that sold lucozade glocose drinks and i drove most of the way to x and back to x on that weekend away.
If I call my insurance company now to include my friend on my insurance, will it state when he was added to the policy? Can I get away with this action?
Can you help me ? I have less than two weeks to respond to the fixed penalty notice and don't know the best way forward.
I would very much appreciate a speedy response.

Driving without appropriate insurance
Your road traffic offence question: Unfortunately due to a hefty work load and other responsibilities i was caught driving without insurance. i was and still am insured under another vehicle and although it is no defence, i simply did not find time to swap vehicle details.
Ther were several procedures the police officer followed which after some research with an aquaintance in the west mercia police, i found to be incorrect?
I would like to stress that i do not condone my behaviour but as a person with a previous clean criminal and driving record would hope there may be something i could do to avoid the 6 penalty points if not the fine which i am more than happy to pay.

Your road traffic offence question: My friend has recently been caught driving with a provisional licence & without insurance with his good friend(who has that car and driving licence +insurance)sited next to him while driving, which was a bad idea to drive without all these. She was told she will have to go to court. She is worried of the charges & point.what the charges might be? Also is it worth booking her practical test as she passed theory test . please help?

Your road traffic offence question: im a newly qualified driver, i was stoped by the police and they run a check and said i had no insurance, therefor this resulted me in getting six points and a fine for driving with out insurance. however i am 100% certain that my insurance was due to finish the following day of getting stoped. how would i go about disputing my case. do i write to the courts, insurers? please help me ASAP. I had a bump in my car today, I've thought I was insured got my policy saying I am insured! I have called today to change my policy registration plate as I have a personal plate and the dvla have asked me to do this
When I did u found out I have no insurance, I was shocked ad I have though I was insured until august, and to top it all off I've had a bump in my car today. So I don't no where u stand?? I now have a new policy in my new plate.
I'm scared and really anxious that I'm going to serious trouble and it's been a total innocent mistake.

I was stopped by a police officer for my veicle not showing to be insured. This was over looked on my part due to a house move. refurbs on my home made me over look the policy my reminder must have been sent to my old address. I have in all the 20 yrs of driving been road legal. Once i confirmed my policy had ran out only by about 2mth i straight away insured my car. The arresting officer informed me it would be a fixed penalty of £60 and 3 points. On producing my documents i was cautioned and told it would be 6-8 points and upto £200. Is this correct. And if so i feel it is wrong that i should be branded the same as some one that does this on a regular basis. I am happy to admit that i was breaking the law but feel 6-8 points is a little unfair due to this been a genuine mistake and my first offence of this sort. Is there any action i can take to avoid so many points ? many thanks

i have recieve a letter from avon and somerset police threw the post, i have no insurance on the car but i was not driving the car, my car got stolen from outside my house, can i still get done for haveing no insurance, i had a drink driving and no insurance disqualificaton 5 years ago, if i did get done would they still disqualification or just give me point on my licence

your site and being fully comp with my own car i was also under the impression that i was covered to drive any car.
Is this worth fighting

my moms car which is fully comp we both have our insurance from direct line.
i already have 4 points.. is it an automatic 6 points or more ... police havnt told me what they plan to do waiting to hear from them

Hi, found your site on the web and I wonder if you can help me...

1. I have my own car (x) and have x fully comp insurance.
2. The x developed a mechanical problem (not drivable). I was considering selling it but still covered by insruance.
3. A Work colleague had an x reg Micra for sale which I purchased as a stop gap solution (£240)
4. Before I collected the car I contacted x to confirm I was insured.
5. More than informed me I was insured third party but didn't (as far as I can remember) qualify this with any provisions.
6. While deciding what to do about the cars I have been driving the Micra.
7. On Staturday xI took my son out to London for the day.
8. On the way back I got stopped by the Police (on the M1) who said the car was not insured.
9. I told the police I had confirmed insurance with x (by phone)
10. The police office phoned x to check.
11. At first x informed the Officer that I WAS insured.
12. The Officer argued for some time that I was not insured because I had now purchased the car.
13. It took quite some time before More Than finally agreed that I was not insured.
14. The police gave me a fixed penalty form (£200 + 6 points) and impounded the car.

My arguments:
1. I have NEVER had any intention of driving without insurance
2. I have NEVER been prosecuted in 40 years of driving for such an offence.
2. I DID phoned x to confirm insurance before I purchased the car and was informed I WAS insured.
3. At first, x even has told the Officer I was insured until the Officer had argued for some time that I was not
4. I REALY was driving the Micra under the belief that I was insured because of misleading Information from x.

I have requested the transcriptions of my initial call to x and the call made by the officer.

I have a construction & groundwork company. One of my sub-contractors was driving a company van and was stopped by the police. I was contacted and asked to go to the incident with the insurance details. When I arrived it became apparent that the sub-contractor was not covered on my fleet policy, the van was but he was'nt. He was given 3 points & £60 fine. I was also given 6 points & £200 fine. I do not feel that I personnaly should have points. I was not in the vehicle with him at the time of the incident.

I ran a car hire business and was accused of allowing a customer to drive without insurance. The person who was stopped by the police did not produce his documents, this is why the officer got me involved.
If I had known that he needed to produce then I would have, but the customer never told me.
What is the worst that could happen?

Have had no insurance since May when my policy was cancelled for non payment.
Am a student and have struggled with finances in the last 3 months and have been unable to pay phone bills, insurance and have had to apply for credit cards for living expenses.
Have been driving my car, and was caught in Newcastle (moved from Manchester to live with a friend as I could not afford my rent) with no insurance.
I have held my licence for 7 years (converted it from a non -EU country licence 2 years ago).
I have not had any penalty points before and also read about the 6 - 8 points, and need to know how many penalty points my licence has before a ban, possible fine and whether the conviction would affect my immigration status. I intend to apply for a post - study work visa in 3 months.

A recovery operator is on a job picking up a driver and his private vehicle which has gone off the road and hit a tree at 2am in the morning.
On the way back the driver of the crashed vehicle wants his smashed car taken to a workshop in readiness for when it opens at 9am. However, the driver wonders how he will get home without his car. The recovery driver says he has a courtesey car at his base and would let the driver use it. This happens.
The driver is in the courtesey car driving home when he has another accident and crashes the courtesey car into another tree.
Police attend the scene and it turns out this driver has no Driving Licence. Obviously the Police PNC will show the owner of the car is the recovery company.
Will the recovery company owner now be charged with Permitting No Driving Licence?

is this right, iv bought a van with tax & mot it was parket outside my house, and because i was sorting my barrel out in the vehicle, because there was no insurence on the van the police done me for no insurence, he said because i had access to use it they gave me 6 point & £100 pount fine.
and my auntie comfurmed that she drives the vehicle for me because she allowed to on her insurence, i said to the solicitor i wasnt intending to use it, it was for selling on, but the court person, dint let me speak, they only heard the police side of the statment, but if you hear my statment at the police station i said it on the tape,
when i got to the police station they said i would prob get away with it because it was daft, but i got done for it please get bak to me asap, because everyone i spoke to said that i shouldnt of got done!!!!!

i recently borrowed a friends van on the advice by my partner meg that we had a multi car policy , comprehensive and that she belived we had 3rd party insurance on any vehicle . iwas stopped by the police given a producer it transpires she was wrong problem is i have 7 points colectively for 2 camera speeding offences from 2007 i am wooried about losing my license can i plead my case.

My son is 16 and has only been on the road for a month since passing his CBT... he stupidly allowed a friend to ride his moped a short distance and she was stopped by the police...she was not insured... they both have been summoned to appear in court...he is very sorry and acted without thinking (normal 16 year old) my question is...will he definately receive 6 points.. or can the magistrate be lenient?

driving without insurance. my mum gave me a car but had it in her name. 3 weeks later i was stopped for no insurance. tht same day i changed the car into my name to avoid my mother becoming involved. at the time i said it was my car and tht my mum had handed it over tht week, (through nerves i exaggerated the truth). this is all in statement by police and has gone to court with my guilty through post mitigation which explains the entire truth. the car is now in my name and it is 3 months later. i am awaiting the court to write to me with a result. will they involve my mum? i havent involved her up until now as she was under the illusion i had car insurance on the vehicle. but i couldnt afford it at the time which the court can see through my mitigation. will they write to me now and ask for mothers details or just deal with me for owning up to no insurance when stopped? if the case is adjourned will it be that they will ask me face to face more about my mot!her? or just disqualification?

I was involved in a small collision 2 days ago (I hit the back of the car which was in front of me) Damage was very minor here. When I phoned my insurance company they advised me that my policy has been cancelled because I missed 1 instalment around 3 weeks ago. The main problem here is that I wasn’t aware that payment didn't go through and I wasn’t aware that I had no insurance at all. Because I moved flats recently I have no internet connection so wasn’t aware of the email which they (1st Central) sent to me "cancellation notice" on x (10 days after missed payment) and nobody was even trying to contact me and ask why I missed my payment also no correspondence was sent to my old/new address? Lady who was in the car which I hit complains about pain in her neck and says that her car had a huge personal value (old x) I don’t know what to do now I admit that its my fault that I hit this car but can Insurance company cancel your policy so quickly? I don’t know what to do next, I would not be driving if I would be aware that I’m not insured (at the time of the accident my pregnant wife was with me 8th month) Please can you help me out here with should I do? I said to this lady that Im happy to pay for all repairs but she doesn't even want to speak with me. I'm also confused but this lady was very positive after the accident and now after this 2 days so is extremely aggressive and unfriendly I have a bad feeling that she will do everything to get as much compensation from me as possible but in this case I don’t think its fair and I have a strange feeling that this person is faking most of the things here.

i was on a moped last year in june i was stoped for a bike i just bought i had fully comphersive on my other bike was thought i was able to drive this with it i just picked the bike up got pulled. i prouduced documents to police staion they sighned it of but i had a letter for court for the offence aprently causr the documents were for the other bike it dont prove i had inusrece and they want to inpose 6 points im onmy loud 6 points be driving for 1 year nearley on ful lience and i already have 3 what wil happen now/ wat can i do it was a long time ago i missed the court date i never got letter due to change of adress so i sent of aplcation to re open it i need to know wat i can do as i have no proof no more as a long time ago and i have a job that i need my car for it. please could you get back soon as possible many thanks .

Hi, at 4:30 this morning I dropped off my brother at the airport, and drove home in his van, I'm insured third party fire and theft, i got stopped on the way home and asked to produce my insurance document at my local police station, i have no points and will pay the fine, however my brother has 3 points already and hasn't had his license for two years yet. what happens next??

I was caught driving my stepfathers vehicle, i honestly thought i was insured fully comprehensive, but i turned out that on my own car (fiat punto, the policyholder which was my brother inlaw) was only the fully comp. when i was stopped i have been given a slip to produce my documents at my local police station, i am 19 years old and hold my live for only 1yr 6 months, so i am still under probation period which means i only have 6 points,
ever since i passed (at 17 years old) only three weeks ago i started driving.
I very much need my car as i am a student and going to commute to university next year as well as need it for my part time job.
I really want to know whether theres any chance of me not losing my license.
Ps, i have never ever been involved with the police.

one of my sons was not well that morning and my older was running very late for schol as my friend who normally picks up was stuck in traffic coming from London and i live in maidehead,

I was approached by an officer as i dropped my son and he asked for m licence i had a provisional because my licence had just been revoked for driving without an insuranc within two years of being a new driver, i had borrowed a frinds car and was not really covered to drive it

he then asked me if i was insured which i was at the time and i gave him my insurance details he then called the insurance company at that time to confirm if my insurance was valid as i was insured as a fully licenced driver and yet i am now on a provisional and they confirmed at that time that i was so the officer then just gave me a fixed penalty of £60 of driving without a fully licenced driver( which i paid and got 3 points on it), it was 6hrs later when i tried to go with a qualified driver to go and pick my car up at the recovery garage that the police then told me that they neededto check if my insurance covered me to drive from a recovery centre it was at that point they told me that i gave insurance false information that i was a qualified driver yet i had a revoked licence which was not the case because when i took the insurance i had my full licence but they would not hear of it, they then told my insurance company to void my insurance,

i have now just received summons from the magistrates court , what is the best plea as i did drive the car with the knowledge that i was insured and i drove it because of the cirmstance i did not have money for a taxi either. Please help me

Also sice my licence was revoked i have tried to take the test twicw already in the month of Apr and May and i did not succed i am now going to retake it in June i really am a law abiding citizen and in both cases it.

First time I have been stopped for having no insurance
As far as I was concerned I had taken the insurance out and paid in full one go
What happened was that the company cancelled my insurance last month as they wanted my NCB proof
They wrote me to ask for it but were writing me on my previous address which I was never receiving, they wrote about the cancellation at also as they say but at my previous address
They had my new address but they say they had the previous address as my correspondence address
Now I have been issued a HO/RT1 form to produce the insurance at the police station in 7 days
Never knew they had cancelled the insurance
Will I be given the option of a fixed penalty or summoned to court ??

I commited an offence of speeding and driving without insurance. I was supposed to present my documents at the police station,which I was un-able to do due to health issues. They then sent me summons to my address as I was un-able to respond immidieately.however during this time I moved houses and my post was returned so I have been unable to trace any details of my summons and I am un-aware of any dates, how can I trace these summons?-as I am un-able to track them via royal mail. Also how can I overcome this offence with minimum penalty?

I have been advised to send you an email outline of the facts pertinent to my case to enable you to give initial advice. Forgive the length of the email, but I want to try and convey all the information to you in what I hope is a clear and chronological format.
1. I was stopped by x police on Friday morning last week (x at approx 0935am) for driving whilst operating a mobile telephone. (There is very little I can say about this other than the irony is I have a work issue mobile phone that has a hands free system, but unfortunately this particular device was broken and the call I was taking on a 'spare' device which was not compatible with the hands free [call was received not made by me] was from my work IT Helpdesk trying to resolve the issuance of a new mobile device to me, and this new device would effectively reactivate my hands free mobile in car system). HOWEVER, I do not wish to distract the real purpose of this email and the background continues below.
2. I was given a ticket for £60 to pay and a 3 point penalty and asked to provide my drivers licence and insurance documents at my nearest police station with 7 days (not yet done this - and your advice is required as a result of additional information below).
3. The Traffic officer conducted all the usual background tests on me and my vehicle (outstanding criminal notices, car registered keeper, etc).
4. Given that you do not know my personal background I would highlight at this point I have never been in any trouble with the law or any other agency in my life and hence these checks all came back clean.
5. However, the Officer's initial checks for car insurance revealed that the Police own database did not have a record of valid car insurance. I did not agree with this and understood my policy was with RAC Insurance. I also understood that I had paid my insurance premium in full at the start of each year which the officer said was a good thing as it meant I would have a full year of insurance and thus in his words '.....I was a decent person who paid for insurance and not someone who set up a monthly direct debit to get the policy certificate and then cancel the direct debit as less decent people do...'. The Officer then said the Police data base was not infallible and as such contacted another person (female lady with American accent) to double check the police record. Again this lady confirmed the police record showed no valid insurance but again the Police Officer advised this was not unusual as she had just checked the same system that he had checked.
6. The female person the Officer had just contacted then agreed to call the Officer back as she would follow up direct with x Insurance.
7. This lady called the officer back (the call was on speaker phone so I was also listening) and informed the officer that x had CONFIRMED a valid policy was in place for the vehicle, but that I was to call the RAC as a follow up. The Traffic Officer asked why I needed to call back (he assumed it was that one of the car licence alpha-numeric digits on my policy may be one number/letter out) and as such I was released from the police car and allowed to travel onwards with my journey in my vehicle. The lady said she could not answer this question due to Data Protection issues. I said I was in the car and on the speaker phone call, but she said Data Protection prevented her from disclosing further details and that I was to call x direct myself. I agreed to do this.
8. I called x Insurance this morning primarily to ask for a duplicate certificate of my insurance policy to provide to the police station along with my drivers licence and I was informed I do not have a valid car insurance! I was naturally somewhat surprised by this. I explained that the Police had spoken with the x on Friday the previous week and that x had confirmed a valid policy was in place, and as such there must be some mistake. Again x checked and said NO insurance was in place.
9. AGAIN (somewhat confused by now) I explained the circumstances and the x to check again as the Police had checked 3 days prior and had it confirmed insurance was in place (and let me travel onwards without impounding my car which I understand the Police would have automatically done had there not been any insurance in place?). The RAC remained adamant that NO car insurance exists. I immediately bought car insurance with them this morning to ensure whatever happens I am correctly insured going forward. The x also confirmed they had NO record of the Police speaking with the x on Friday the x or any other day. I asked if there was another dept that the Police call, and I was told no there was not.
10. However, despite my protestations that I thought I was already insured (a fact they confirmed to the police 3 days prior), the x are continuing to say I did not have valid insurance at the time of the offence on Friday last week. Therefore, I am now very concerned about the possible implications for myself if I did not have insurance but had wrongly assumed I did have insurance. The fact the Police confirmed a valid policy was in place - where do I stand? Do I face Points, a fine, or even worse? Could this result in a criminal record against me?
11. Furthermore, given I still have yet to produce my documents to the police station within the original 7 Days of the mobile phone offence, I am now very concerned that giving the police a copy of the NEW car insurance policy bought today that shows a start date of today (and not the date of the mobile phone offence for which I was originally stopped) will suddenly trigger all sorts of new problems for me. Given that the police were told I had insurance (and I genuinely thought I did have insurance) is there any mitigating action/commentary I should be ready to provide to the police at the same time as I provide my drivers licence and insurance document? What else should I expect? Will I have to go to court to resolve the Insurance part of this problem? Whilst I doubt it is a pure defence, and assuming I did not in fact have valid car insurance in place, does the fact I thought I did and also the fact the Police also thought I had insurance give me any 'protection' from a charge of driving without insurance? Afterall, If the Police own investigations confirmed I had valid insurance, is it not reasonable that I also thought I had insurance (again assuming I did not actually have insurance)?
I hope this helps give you the background you need, and I would welcome your advice and recommendations, especially with regards how I handle the problem of producing my documents to the police that would seem to suggest the original mobile phone charge may be added to a more serious lack of Insurance charge?

Firstly thank you for taking the time to read this. I was recently stopped in a road side police check using the ANPR system. I spoke to the police traffic officer on the roadside and made a full disclosure to him that I had no license or valid insurance. My car was seized for not having valid insurance. I was given a notice that I would be summoned to court for both offenses. A few weeks later I was sent some forms regarding the matter and I chose the option of sending my guilty plea by post and not attending court in person. My court case was heard on Friday x. I now remember that I was supposed to fill in part of the form with my mitigation and also my current financial circumstances, I assume this was to determine a fine, however whilst I was completing the form I wasn't fully certain of my family income (In/Out goings) so I left that part until I had discussed it with my wife. I then stupidly forgot to fill in that information and sent the form to the court without it. I have only just realized my mistake! I have just contacted the court to explain this and find out the outcome of my case however I was informed that they could not discuss this information regarding not completing my financial situation and that it is too early to find out the outcome of the case. So my question(s) are- What is the penalty for no license or insurance (will it include a ban) and also will not providing my financial information increase any fine I may receive? I'm so sorry this is so long winded! I hope I have given you enough information though? Thanks in advance!

Hi. I had undertaken an insurance policy. The insurance company sent all correspondence to a different address than my home one, ten doors down, which was then returned to the insurers. They issued a cancellation document to this address which I obviously never received.
After three days of my policy being cancelled I was stopped and charged with no third party insurance.

My father has bought a car for me and him to share, he is the policy holder and i am a named driver. He payed for the car and i pay the insurance. I use the car through the day and my dad uses it on a night, is this 'fronting' which i know is illegal or is this perfectly legal? Get back to me A.S.A.P, thank you

I have been driving since x 10 and Last month i was stopped for no insurance. Last year, my dad paid for my insurance. I didn't recieve any notice this year from my insurance company so assumed that the cover was automatically renewed and my dad was still paying it. In feb 10, I taxed my car over the phone and it all went through ok. At the time I was working in Newbury and driving back and forth from Wales every weekend. I no have a court date to appear at and i don't know what is best to do? I really cant have a ban, We live in the middle of no where!

I was stopped on x2009 for not having insurance. I was adamant I had as I had recently had my renewal docs stating take no action as it will just continue. Police gave me a producer. I took my docs in and police said no actual cert so I contacted ins co who advised they had written to me regarding unpaid direct debit (I was moving banks) and cancelled my policy. They state they wrote to me 3 weeks before they sent renewal docs. I produced all docs on x/2010 and police were sympathetic as subsequent letter indicsted a was insured. It is now more then 6 months since the actaul offence date and I have heard nothing. Is it likeley I will still be charged?

Was driving my Wife to hospital when my car was hit by a car pulling from the curb. I was going slowly but he still hit me and caused damage to the wing of my car but no damage to his. I filled out an insurance claim with my insurer online only to discover that my policy was not automaticly renewed as I expected it to be in previous years. There is no police involvement and my old company have reinsured me today. I have swapped contact details with the other driver who did say that he was insured by the same company.
I know I should have check the renewal but I'm more concerned with the driving without insurance than the damage to my car caused by the third party who admitted fault and said sorry.
I'm assuming its best not to contact the vother driver and hope this goes away? and tel my insurance to drop my claim which is invalid in any case as the policy was expired.
Any views on what I should do?

My sister was stopped by police and was given a 21 day slip to reapair faults to her car she forgot to hand in the slip the police then returned and asked more questions they found out she only had a provisional and that no-one was accompanying her over 21 etc when she was driving/ stopped that day and this invalidated her insurance can they still prosecute her even although they didnt find out about her having no licence 2 months after they stopped her the first time?

My 17 year old son rode his friends moped with his permission under the mistaken impression that he was insured through the comprehensive insurance he has for his car. My son then gave a 14 year old friend a lift and was caught by the Police. At the time the Police asked if he had permission to use the moped because if he hadn`t he would be in trouble, but if he had the owner of the moped would be in trouble. My son didn`t want to get his friend in trouble for him having another person on the bike, so he stupidly said he didn`t have permission, which is TWOC.
When I found out I told him TWOC is a crime so he must tell the truth. Now his friend is saying he didn `t give permission for use of the moped, as he doesn`t want to get into trouble himself,so my son and the 14 yr old may be charged with TWOC, yet earlier in the evening the moped owner allowed the 14 year old to ride the moped,even though he knew by the boy`s age he was uninsured and without a licence, my son witnessed this.
We don`t know what to do as my son will lose his placement on his apprentcieship if found guilty of taking without consent. My son is a provisional driver. What would happen to the moped owner if a) he admitted giving my son permission as he thought he was insured or b) if he continues insisting it was TWOC and my son has to inform the Police he did have permission and the 14 year old had also been given permission and had rode the moped earlier ? Can the moped owner just drop charges against my son and the 14 year old without getting into trouble? It is only fear of getting into trouble himself, that is making him say it is TWOC.
We really don`t know what to do.

car got impounded for no insurance, got insurance now and valid mot and logbook, gone to collect and have been informed that my driving licence has been revoked for some reason i have 6points as far as i know,i have until the 8th June to take my car out! please help any solutions i had a problem with my previous insurance's i did pay in full but due to lack of communication they gave me a full refund and cancelled my policy, i only found out the day my car got taken.

My friend was driving the car I rented, and was caught speeding at 37mph on a 30mph road. I was feeling unwell at the end of the day so I got him to just bring all of us home.
My friend has been an international student for over a year, and hence his licence is invalid (which we didn't know). He also does not have insurance (which we didn't know about). We are both international students.
What will happen to us, and will this affect our applications for work visa??

Fair game i got caught with no insurance, upon receiving the optional attendance court date i didnot attend and sent in a statement of means form to the court.I heard no more, until i received a further steps action letter for non payment of a £200fine On the x.I responded to the letter by recorded delivery to say i am willing to pay the fine by installments as i am on a low income (benefits).That i have adhered to their rules by sending in my statement of means form and its not my fault i was unaware of the fine. That someone should assess my case and make a payment plan.No one sent any correspondance until 11 days ago when i received a balliff letter issued with a warrant of distress. The letter states i should make payment in full for £275 within 7 days or my belongings can be auctioned at court.The baliff has refused to set up a payment plan because its a magistrate fine. There is no way i can pay this in full is there any thing i can do, as i feel its unfair the court has not set up a payment plan as im on benefits, and i have had the fine increased by £75. Im petrified the baliff will attend and take my familys belongings.

I was driving a car without insurance and MOT. I had two passengers in the car: my daughter and a friend. I think that the police did not see me driving. They approached me when I was parking near x airport, and asked if I had insurance and MOT. Now I was charged with offences contrary to s143, s47(1), 40A of Road Traffic Act 1988 and Schedule 2 to the Road Traffic Offenders Act 1988. I am the owner of the car.
1)Would it be reasonable for me to plead not guilty and argue that I did not drive the car but my friend did? The friend would say that I was driving the car.
2)Is it possible, with todays technology, to prove who was driving?
In such case, maybe the prosecution would be unable to prove who was driving, and would have to drop the case.
3)Is there any accessory liability under the RTA88? for example to allow to drive the car to a third party with me present in the car.
4)If I was found guilty, how many driving points would I lose? And how many are there before you prohibited to drive?

I have been endorsed with 6 points for the above offence, this was a result of my brother driving my vehicle when I believed he was covered by his own insurance. This was explained to the police at the time of the incident and I was advised that I would nbot be prosecuted nor would I receive points on my license. Now I have been endorsed with 6 points I would like to know if I am able to appeal against the conviction.

Hi there, I been caught on the raod by the police with no insurance. It was my misunderstanding. I was insured in my dad's car as a named driver. I thought i could drive other cars as far as the car i was driving is fully insured. Obvisiouly when they caught that wasn't the case. My French cousin came over and borrowed our car and was caught doing 41 in a 30 zone. He said he had insurance but police intend to prosecute anyway. I can't get hold of the cousin so cant prove he did have insurance and since my car was not insured for 3rd parties do I have to carry the can?

i was driving a car borrowed of a friend, the car was on a any driver policy, i got stopped by the police and was given a producer. i produced at the station and the police officer said that it was fine, the insurance was valid, i then borrowed his other car, which i got stopped in again, this time the car was compounded, and i'm worried that he may have lied to me and that the car may have been uninsured, although he did show me a cover note, saying that the car was on a any driver policy, if he does not produce i shall be summoned to court, therefore i wanted to know what would be my best defense, and would i be held liable? thank you

I have been charged to court for allowing other persons to drive without insurance. The third party has driven the car without my permission and am not aware of the action until when i saw a letter asking me to produce within seven days. I contested the allegation and gave the name f the driver and have now been charged for the offence. Case is slated for 17/06/2010. Dont know what to do...please help.

while driving home from work last thursday 27 may i was pulled on the m5 for having no insurance which was news to me as i had taken insurance out with swinton on the 12 may just gone. after the t/officer rang the insurers himself the lady on the phone said my policy wasnt due to start till the 12 june so i wasnt covered, vehicle seized! when he then checked on the radio about my liscence as i cant find mine he said it had been revoked in 2006, which after racking my brain i realised that it was for not surrendering it for driving a workvan with no insurance and tax also non preduction of liscence. as i had moved and not updated my address i had no idea that i had had my liscence revoked and had been driving for four years without one unwittingly! so.... i have now applied for a my liscence will it come back with pionts on as i was pulled in april or may 2006 and how many can i expect for the above mentioned. my insurance would of been legal as of 12 june and wouldnt have any reason to post date it a month. i need my liscence for work and my partner is expecting baby no 2 as a carpenter it is simply not possible to work without driving. help please!!!!!

I had temp cover on my car, we have a very bad bend by our house, and as I was slowly pulling out, a white van came flying round the corner and hit us. The police were called and when I checked my Insurance it had ran out 5 hrs earlier.
I own another car which im fully insured with, does that cover me to have driven the car under third party rules

was stopped by the police on Thursday for driving without insurance - a fact I was blissfully unaware of.

My insurers were RAC - I've been with them for years.

The renewal package arrived as usual in March. I opened it and then plonked it in the folder I keep for the car (MOT etc).

I did not read the whole document so did not realise that this year (for the first time ever in my 35 years of motoring) I actively had to phone them to renew. In every other year it is the opposite - you have to take action if you want to cancel the policy.

The company told the police officer (and also told me later) that the reason the arrangement had changed was because I had cancelled a second policy with them last October (for my other car). They said that because the two policies were linked there could no longer be an asumption that I would renew.

Later, when the complaints department called me they said that the above was not true and that, because of restructuring within the RAC, they were updating customer details.

They refused to confirm if the new system applied to all customers or just a percentage.

I'm guessing you will say it's my fault. However, I am checking this out because I feel so angry about the situation. I now have 6 points on my licence, have had to take out new, expensive insurance, had my car locked up in a pound and will have to pay a fine. Not to mention the humiliation/upset/tears of yesterday.

Do I not have any reasonable expectation, as a long term customer, that the industry and company 'normal practice' will apply? If they change something so fundamental should they not notify people via a separate and very clearly worded letter?

I was stopped for dricing with no insurance and issued a £200.00 fine and 6 points. I was coming to the end of my time in the UK and had not renewed. No excuses. I had 3 weeks to go. (i am a uk citizen). I insured the car, picked it up next day, surrendered my license and waited to hear. I informed them I lived in x for the near future. Gave my uk office address as point of contact.
I travelled to x without picking up my license and have worked there for 18 months. I am now returning to the uk as the contracty has ended and need to face the music so to speak. Obviously I guess that I have some outstanding fine and this , I would guess has been rererred to Magistrates court as the company I had worked for closed very quickly after I left. I am obviously happy to pay my fine etc. as was in the wrong. What I want to know is whether I am liable for any form of arrest at the airport for this or am I over reacting?
I am guilty but would rather not be carted or at customs. I was a law abiding person with no record but flounted the law and was caught, fare game. I am not used to this and am told I have to just go in and settle my outstanding debt.

i have been given a fixed penalty notice of 200 pounds. i was given the ticket at 23.35. however i got a temporary insurance done at 23.32 through my wife and therfore i believed that i was insured. but the fact is the insurance started at 23.45. i genuinely believed that i was temporary insured. i have evidence that i got myself insured.
i would like to know whthere i should accept the fixed penalty or go to court and argue special reasons?

My husband was stopped on the way home from the dentist on Tuesday morning and received a £200 fine and 6 points on his licence as well as having the car pounded. This cost an extra £150 to be released. My husband was driving my car which was recently bought so our son could learn to drive. My husband is not a named driver on the policy but he does have fully comp on a van he drives and is a named driver on another fully comp insurance on the family car which I'm the main driver. He believed like many that he was covered third party to drive the car in question. I understand the severity of the offence, but I have been angered by the fact that as a genuine law obiding citizen, my husband has been penalised harshly for a genuine mistake. I've tried to appeal the penalty and the police did ask me to contact the insurance to ask for an indemnity letter stating that my husband was covered 3rd party on the vehicle for that day. They would then drop the case. The insurance has refused to do this of course therefore I am back to square one. What gets to me most is that there are genuine law breakers out there who have no intention of insuring their cars and are getting away from being penalised.
I understand that I don't really have a case on the issue of the penalty, but what is the law on pounding the car. We were not allowed to move the car off the public road for a later pickup. The police instructed a local garage to pick the car up and tow it away where we had to later pick it up for a fee of £150 - half of which goes to the police and half to the garage. This really is easy money to the police and I'm really dissapointed that there isn't a lesser penalty for genuine mistakes especially when we are paying fully comp insurance on 3 vehicles and always declare the points if we have any.
I really would like your response on the whole matter but the pounding is what I would really welcome your response on as I believe there is nothing I can do about the rest!

i just got a car and i went to a meeting i parked and was in the meeting i had to go because of my kids . there was a car double parked behind the car next to me and i did not see it and i cliped it i had not got insurance yet. shuld i have to pay her insurance company back .can thay send that to a bill collector and will it affect my credit if i dont pay . i dont feel i was wrong. thay have my bank account number what do i do???

I moved my girlfriends car for her in a carpark. And another driver went into the side of my girlfriends car and then crashed in to another car. The police were called and I believed I was coverd as I am fully comp. It turned out my policy didnt cover me as im not 25 so I had 6 points and a £200 fine. When I phoned my insurance they have told me that they will cover my girlfriends car 3rd party would it be possible to get the points taken back and the fine. The insurance company told me over the phone that im not insured to drive other peoples cars 3rd party as I am not yet 25 but also said they would cover my girlfriends car 3rd party if proven it wasnt my fault but if proven its my fault they will take care of the repair of the other cars involved. I was stopped by the police and asked for my insurance certificate. Although I produced a valid certificate to the officer who stopped me, she insisted that she had called my insurance company who had claims that I have cancelled my insurance. My certificate was retained by the police and my car was ceased by them as well.
The next day I went to the police station at which time the police realized that I had a valid insurance certificate. However, it cost me £150.00 to get my car back. Since I was not at fault initially, I asked the police to pay me back my £150.00. As a result of my request, the police stated that I did not disclose to the insurance company at the time of renewal that I had a conviction in 2008. To this I replied that the question asked as I applied for the certificate online was 'For the past 5 years have you had a conviction that is pending? I said 'NO' because in honesty I did not understand that the offense in 2008 was for which I had been penalized was a pending conviction. Following this enquiry by the police, my insurance company cancelled my contract with them.
My insurance company has not brought any case against me but the police have called me in and charged me for fraud. I have been issued with a court summons on 10 May 2010.
I obtained another insurance certificate to enable me use my vehicle. However, since that time the police have stopped me once and come to my house once with two police cars arousing great concern in my neighbourhood. Where do I stand?

My wife was driving and a young driver carshed into the side of our whilst making a right turn, other driver admitted he was at fault, we have a witness(with contact number), our insurance company stopped our insurance as we defaulted in two monthly payments, which we did not know about, other drivers insurance company now says its out fault and wants damages and want our insurance company details, the cars postion shows that they are to blame, but we cant efford to defend ourselves unless we can get legal aid.also cant efford to pay their damages either,think its terrible that its their fault and we seem to have no way to defend ourselves.

I am just emailing for some advice. I was test driving a friend’s car and was covered under his trader’s policy. I was pulled over and given a producer. My friend then went out of the country for 2 months so I was late producing. When I went to the station to produce they filled in the hort/2 form and everything was fine. I have now received a court summons and I am unsure why. Also does it matter that the car wasn’t actually registered to my friend as he has just decided to tell me this. Is it just a case of taking the hort/2 to court or will I be accused of driving without insurance. If so, I have only been driving a year, is there any way I could avoid the 6 points. I have never offended before and would lose my job without my car.

I am so scared now, however I am in the process of receiving an indemnity from my ins company to say I was covered at the time (their computer system messed up my ins renewal) Do I go to court and produce this evidence or do I go directly to the police with this evidence?can a court summons be cancelled once issued?

i was aware that i was insured as a fully comprehensive driver, i was pulled over and fined 200 pounds and given 6 points on my liscence, i have also had my liscense taking away. is there anywhere i could protest against this?

On the 2nd of July I was stopped for driving without insurance. When I was stopped my boyfriend’s car was towed I was not actually handed a penalty notice which made tracking my case extremely difficult. I called the MET office and the DVLA on numerous occasions, and even asked my brother in law who is a policeman at the MET to try to find my case, but everyone told me that there was no record of my case.

More than 8 months had passed and I have never received my summons. I was completely unaware that there were proceedings being held against me until I returned from holiday on the 24th of April to find a letter from the DVLA at my home address requesting my licenses and a letter from the Fine Officer demanding a £610. I have since learnt that my case was on the 5th March 2010 8 months after the offense.

Although I am guilty of driving without insurance, I was completely unaware at the time that I was driving uninsured since it was my partner’s car and he had a monthly DD set up to pay the insurance automatically. Neither us knew that the policy had lapsed. The letters that HSBS claim to have sent had never been received by us and we had never received a call from them or the bank to tell us that the DD had bounced. So adamant was I when my car was towed that I was in fact insured that I made the PC make a special note to the fact on my statement.

I wanted to appear in court to plead me case, that is was an unintentional offence, that as far as I knew my partner had done everything in his power to pay the car insurance with regularity and that since I have a 2 year old daughter and need to able to drive so that I can pick her up from the childminders after work and therefore would suffer terribly from a 6 month ban.

Furthermore, I have been fined £525 which incredibly high given that the statutory fine is £200. I do not know why the fine is so high since I was not in court to hear to case. I am convinced that I would have been able to have it and the ban reduced had I been able to put my case forward.

However, since I never received my summons I was never given the opportunity.

What should I do? Should I make a statutory declaration even though I guilty? Should I appeal?

I got pulled over today for speeding. 50mph in a 30mph zone. I genuinely wasnt aware it was a 30mph zone.
To add insult to injury the car that we had borrowed off of a family member, whilst he sourced a new car for us (he is in the the motor trade) turns out that we were not covered on his trade policy, even though we were told we were.
We presumed we had cover, as did our family relation, but on closer inspection his insurance policy is named drivers only.
Does this case have to go to court or could we settle out of court (Special Reason) ?
We accept the speeding fine (and points) but we genuinely would not drive knowingly without insurance cover.
We have a new born baby and i work as a nursery nurse so this is somewhat concerning for me as i need a car on a day to day basis.
I have no previous convictions.

Hi, I'm a Provisional licence holder and was practicising with my husband who is a full UK licence holder since 1990 / 39years. He has comprehensive insurance under his name (though I'm not a named driver on his car/insurance).
PLease can you confirm the legal requirements that I need to be able to practice driving with my husband. Also, do I need to be named on his insurance even if he comprehensive insurance.

I was stopped yesterday for no insurance (ANPR check)while driving my daughters car. I knew her policy had been transfered to another vehicle but I beleived I had cover under a motor trade policy with my employers. I do in fact have an expired certificate naming me on the policy for trade purposes and SD &P use. I have sold her vehicle today. My purpose for driving it was purely to make sure everything was ok with it. It had been standing for a few months. It has now transpired that the policy I was covered on has been changed to a specified vehicle policy, so the vehicles are all insured for anybody in the employ rather than named drivers on any vehicle. The admin were supposed to tell us by email but I was left off that circular. OK I understand will get a fine and points but is there any mitigation I can use? Will my daughter get dragged into this too? I have been driving for over 40-years with a clean record. Thank you.

My 15year old son drove his friend's scooter without having a licence, he wasn't wearing a helmet & nor was he insured. He's received a summons which states that he can enter an early plea of guilty to the court but we should speak to a solicitor first. My insurance company canceled my insurance without telling me, within that same month i was pulled over by the police for driving without insurance. i told the police i had insurance as i was sure that i did. The police confiscated my car and left me standing in manchester. i wrote a letter of complaint to my insurance company and asked them to re imburs me the money it cost to get my car back and to tell the police it was their mistake, cancelling without notification. they refused to do so. They wrote back to me saying that a letter had been sent out, and that it was not their resposibility wether i had recieved it or not. My insurance and breakdown was with the same company, Direct Choice, my insurance was up for renewal, and i thought this was done automatically, like the breakdown, as i had recieved a letter about the breakdown saying that it was going to continue automatically and that i need not contact them, and i assumed the same about the insurance, as its the same company. i also had been in contact with them frequently during that month as my car had broken down several times, and i rang them direct quoting my insurance policy number, before being re- directed to their breakdown office. I was not addressed about not being insured at any of these conversations.I am very distraught about this, i have never had any points on my licence, in my 7 years of driving. Please advise me how to proceed with this, as i am currently going through a divorce and have 3 children, and need my car each day for school and work. i honestly believed i was insured, i would never have driven the car had i known i wasnt, and was in absolute shock to find out that this had been the case for weeks!

About 1 1/2 month ago me and my fiancee from Egypt were travelling on the motorway back home to Aberdeen. I allowed my fiancee to drive the car for a short while, which is only insured by my name, because I was 36 weeks pregnant at that time and was feeling very tired. Unfortunately the police stopped us and my fiancee was asked to provide them with his driving license but they did not recognise his license as it was in Arabic script. We have now received a letter from the Procurator Fiscal charging us with the following:
- My fiancee: for not producing a driving license in a format which could be verified
- My fiancee: for driving the car without insurance
- Myself: for letting him drive without insurance.
Could you please provice us with some information on what would be the likely charges (fines, penalties) for us in this case. Should we just plead guilty or can we provide any information to the Court that would reduce our charges?

I was stopped today by a police car using ANPR and my car impounded for driving without insurance. I have no prior offences, no points on my licence, and have been driving for 5 years with only 1 fixed penalty notice in all that time, for my car being inside a yellow hatched box at a junction.
I'd taken out insurance with Churchill last year, via the internet. They cancelled the policy because I hadn't provided evidence of eligibility for a No Claims Discount, but they never attempted to email me or phone me, even though the policy was taken out on the internet. They wrote to me but at the time of writing, there was an ongoing postal dispute in my area and the letter(s) never arrived. I can show that during the same period, other mail was never delivered, of equal importance, eg letters to and from the DVLA in Swansea vanished, letters regarding a passport application vanished, and even registered items simply dissapeared from the Royal Mail system and became untraceable.
So I feel I have Special Reasons Arguments that I had no reason to believe my insurance had been cancelled. But is there a real danger that magistrates might impose a heavier penalty than 6 points + £200 fine ? I am 45 years old, of good character, have no criminal record, need to be able to drive in the UK and overseas for work; and 6 points on my licence will mean higher insurance costs for many years and may prevent me hiring & insuring a car overseas. But a heavier penalty would mean even more problems.
What is the most sensible thing for me to do ?

I was stopped and the officer found out i had no insurance. I passed a year and a half ago, and since i wasnt in employment my father agreed to pay the insurance for 2 years. Unfortunately he left the country to go abroad a month before it expired, and my partner was expecting our first child around the same time, and had complications which meant she was hospitalised. This meant i couldnt be at home as often, and perhaps i would have realised the error. I was therefore driving without insurance for a month. My partner works, and i travel to take our daughter to feed since she doesnt take formula, and am in the process of getting a job as a delivery agent.My mum also has diabetes which means i have to do a lot of travelling in picking up my sister. I also had 3 points prior to the event for driving 84mph in a 70 zone, and therefore would be disqualified under the toting up system. I opted for a court hearing, and am wondering what my chances are of leniency in recieiving the points which would disqualify me

I drove my 16 year old son to an industrial estate at 4.30pm on a Sunday afternoon and i let him practice a 3 point turn and reverse corner in my car with me sitting beside him The police turned up and questioned us then impounded my car and have given my son a driving with no insurance form and told me him that he will go to court. At no point did they ask who i was or take any of my details even though i explained to them that he had not driven on the road and was only practising manoeuvers. I told them i had insurance to cover me in the vehicle but again they were not interested. I need to know if i have any defence with this? I don't see that it is in the public interest for them to convict a young boy who attends a private school and is an exemplary student and has never been in trouble with police. I am hard working honest woman who was just trying to help her son learn driving techniques early.

Do the circumnstances in which the police pulled over the driver have any bearing on the charge of driving without insurance. ie could the driver claim that the police had no right to pull over the vehicle at the time?

I Was stopped in Oct 08 By Police stating that i had no valid motor insurance. I showed my insurance document & They said that if i showed that at the police station within 7days i would be charged for using false documents.
I contacted my insurance company the day later and they said that my insurance had been cancelled. But i had not been giving any notice to this, they claimed that it had not been paid. which i was unaware of.
I contacted the police and they said they would contact me when i would appear in court to have my say...
In March 2009 i received a letter from north tyneside courts telling me i had unpaid fines.
When i contacted them they said i have been convicted of driving without valid motor insurance & my licence had been revoked without any notice.
I wish to appeal against this decision as i feel my insurance company should have notified me about my insurance being cancelled also i feel if i had of been present at the hearing i could of had my say on the offence.
I have not had any previous convictions before this and has reduced my chance of getting employment.
Is there anything that could be done about this at court?
maybe getting my licence back or having my points revoked for alternative punishment? if possible

i never produced to the police so therefore i could not show them my insurance papers, they sent me to court and i failed to attend with this they sentance me in my absence and found me guilty for no insurance, but i do have insurance as the motor was insured in my mothers name which was insured for any driver therefore i was insured but was absent from court, the court took 6 points off my lisence and gave me a £500 fine, please could you give me advice on what to do next thankyou x

my husband and i bought a new car,i have phoned our insurance company to transfer the insurance on the new car the next day at 11am as we are picking it up at that time and part exchanging the old car.the next day i went to work and my husband with my children went to pick up the new car but a bit late at 11:05 on their way to the garage about 3 miles away,my husband was stopped by the police due to driving without insurance,my husband told the police officer that he was picking up the new car etc. the police officer phoned the insurance company of my husband to extend his insurance up to 12 noon to get to the garage to pick up the new car and the insurance company with no problem has done so. but despite the extension of my husband insurance to 12noon the police officer still issued penalty for £200 and 6 points on his licensed, isn't this unfair and we want to appeal this in court. do we stand a chance??my husband has already have 3 points on his license for speeding in oct.2007.so he is very distressed about the 6 points penalty.please advice us.

I was stopped by Patrol Car,when looking for my documents I found that my insurance is not up to date,i thought my daughter who works for the company had renewed it after supplying me with the quote.I have six points on my licence and my job is a lorry driver.I fear I will lose my job,if i get more points.I have to produce by tomorrow

i was driving my friend,s car.i had insurance on my car.but company cancled it because i cancled driect dibt from my account,because i was going back home for holidays my father died.i came back,my company remove me from job.and it was sort of company house.so i didn,t go to that town after.so i didn,t recived any letter from company.so how many points i am going to get.

I insured my car online with 1st Central Insurance on 27 February 2010,paying a deposit of £223,which i have proof.I recieved an E-mail instantly saying that my policy was'In Force'.2 weeks later i was stopped by Police,to find out that i was uninsured.I made a mistake on the keyboard of my laptop and put in 27 March instead of 27 February.A simple mistake.Why would i pay a big deposit& wait a month to drive?I have wrote a letter to the court about this.I am facing a £200 fine and 6 points on my licence.Is it worth taking to court?

I just bought a car a few weeks ago and i got it cheap because the MOT was due to run out soon.. I let it lapse and it had already run out a week before I had time off work to take it to a mechanic to get it sorted... I was driving to the mechanic when I passed a police car and looking in my rear view mirror I thought I was safe... Ironically I was just pulling up to the mechanics to get my car MOT'd when the cop pulled up and asked me if I had the proper papers.. I had an appointment with the MOT place and I told him that I had my car registration papers because I just brought it in for that and when he asked me if I had insurance I admitted that I did not... I got taken into his car and he asked if I had a UK license and I told him that I had an EU one although my license is actually from outside the UK but still acceptable as a valid international licence... The only problem is that as I've been in the UK for longer than a year I can't use that as an internation licence anymore which is why i was in the process of getting it sent out and getting a UK one right after my car would pass the MOT (I didn't want to find my car would fail the MOT and have to scrap it not to pay a hefty fee to fix it and be carless and pay out money for new licence without using it.)... The cop gave me a producer and a fine for 200 pounds for no insurance... he also took my car away for no MOT and no insurance... Now I have a week to go to the cops with my licence which I can't even find at the moment so don't know what I'm going to do, to order a replacement i need to contact the country of issue and that could take more than a week... What do I do, I know i've got a hefty fine for no insurance and 6 points if and when i get my UK licence but what if i can't produce my international licence. what are my options, please help..

I am a Self Employed Financial Adviser who has 6 points on my licence already. I have been caught with no Insurance on my car but the Insurance Company cancelled the insurance policy without my knowledge. Will I lose my licence? I need my car to work!

Im driving a car which have insurance under my name but i have got a business and i don’t use my car for business purpose but one day my delivery driver broken down and i have to deliver the food to my customer because its getting late so i go for it and police caught me i told them all the situation but they charged me and now i have to go to court and if i got 6 points i have to lose my licence coz i recently passed my driving is there any chance not to get points i m wiling to pay more fine but no points coz i have business and its away from my home if i lose the licence i have to lose my business as well.

Can I be prosecuted for having no car insurance whilst inside a hm dockyard which is private land? I was at the time a named driver on another policy

Due to an oversight with a standing order I was stopped by police for driving without insurance and my vehicle was seized by police. I was not reported for any offence at the time and was told that due the circumstances I would only be warned. I subsequently went to the police station with all correct documentation to recover my vehicle but the police refused to release it because apparently I should have been reported for driving without insurance and been issued with a penalty ticket and the officer who stopped me is on leave until March and they need to speak with her before releasing my vehicle, which I need for work. Are they allowed to do this.
